SUMMARY

OF THE 2022 NUCLEAR REGULATORY COMMISSION WORKSHOP ON VENDOR OVERSIGHT From June 1 to June 2, 2022, the Office of Nuclear Reactor Regulation, Division of Reactor Oversight, hosted the Nuclear Regulatory Commissions (NRCs) 8th Workshop on Vendor Oversight. Due to concerns regarding the COVID-19 pandemic and the importance of social distancing, the NRC held its 8th Workshop on Vendor Oversight virtually. In order to maximize public participation, the workshop was offered over two days. The NRCs 8th Workshop on Vendor Oversight began with opening remarks by Ms. Kerri Kavanagh, Chief, Quality Assurance and Vendor Inspection Branch (IQVB), followed by the keynote address by Mr.

Chris Miller, Director, Division of Reactor Oversight (DRO) in the Office of Nuclear Reactor Regulation (NRR), as well as presentations by the following members of the NRC staff: Ms.

Deanna Zhang, Mr. Yamir Diaz-Castillo, Mr. Douglas Bollock, and Mr. Yiu Law. Presentations were also given by Mr. John Larson from the Cooper Nuclear Station, Mr. Marc Tannenbaum from the Electric Power Research Institute (EPRI), and Mr. Mark Coren from Duke Energy.

The 8th Workshop on Vendor Oversight included presentations on the following topics: (1) the NRC staff's response to the Office of Inspector Generals (OIGs) report on Counterfeit, Fraudulent, and Suspect Items (CFSI); (2) Nuclear Procurement Issues Corporations (NUPICs) audit team and supplier interface before, during, and after the audit; (3) assessment of laboratories owned by the U.S. Department of Energy (DOE); (4) commercial-grade dedication inspections at licensees; (5) lessons learned from inspecting during a pandemic; (6) implementation of the EPRI guidance on hybrid and remote assessments; and (7) lessons learned from implementing the EPRI guidance on hybrid and remote assessments. In addition, there were two open question and answer (Q&A) sessions each day of the workshop. The audience included approximately 300 attendees representing companies and organizations from 10 countries including vendors, industry groups, government regulatory agencies, and both foreign and domestic utilities.

The accession numbers for each of the presentations are provided in summary below.

Day 1: June 1, 2022 Ms. Kerri Kavanagh provided opening remarks and introduced the keynote speaker, Mr. Chris Miller. Ms. Kavanagh welcomed the attendees to the 2022 NRCs 8th Workshop on Vendor Oversight and provided brief remarks on what to expect for the next two days.

Mr. Chris Millers keynote speech briefly touched on several topics. Mr. Miller provided remarks regarding the continued impact of the COVID-19 pandemic on the supply chain and the oversight of vendors. Mr. Miller mentioned that the NRC staff has approved several alternatives to address challenges with performing audits, commercial-grade surveys, and source surveillances during the pandemic. Mr. Miller emphasized that Appendix B, Quality Assurance Program Criteria for Nuclear Power Plants and Fuel Reprocessing Plants, to Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Domestic Licensing of Production and Utilization Facilities, requires on-site direct observation. As such, any changes in the way audits, commercial-grade surveys, and source surveillances are required to be performed must be done through rulemaking. Mr. Miller clarified that the NRC staff is not pursuing any rulemaking at this moment. Mr. Miller discussed the importance of having a strong safety culture at all organizational levels and how establishing and maintaining a safety conscious work environment is an important element of strong safety culture and requires hard work and continuous monitoring. Mr. Miller concluded his remarks by talking about his experience while on rotation to the DOE and how he was able to view firsthand some of the efforts by DOE to encourage and strengthen the use of nuclear energy to support the U.S. energy and climate goals.

Ms. Deanna Zhang, Senior Reactor Operations Engineer, NRR/DRO/IQVB, delivered the presentation Counterfeit, Fraudulent, and Suspect Items: NRC Staffs Response to the Office of the Inspector Generals Report (ADAMS Accession No. ML22137A144). Ms. Zhang presented an overview of the findings and recommendations identified in the OIGs audit report and special inquiry on the NRC staffs oversight of CFSI at domestic nuclear power plants. Ms. Zhang also discussed the NRC staffs response to the OIGs audit report findings and recommendations.

Ms. Zhang highlighted that the NRC staff has taken a proactive approach to its oversight of CFSI through issuance of CFSI-related guidance, development of processes to evaluate potential CFSI events, and performance of outreach activities with internal and external stakeholders. Ms. Zhang emphasized that the NRC staff conducted a review of the information presented in these reports and concluded that there was no evidence found to substantiate that NRC regulated facilities have been adversely impacted by CFSI.

Mr. John Larson, Quality Assurance Supplier Leader, Cooper Nuclear Station, delivered the presentation NUPIC Audit Team & Supplier Interface Before, During, and After the Audit (ADAMS Accession No. ML22137A167). Mr. Larson discussed the actions that both the NUPIC audit team and the supplier being audited should perform before, during, and after the audit.

Some of these actions include scheduling the audit, selecting the audit team members, the supplier becoming familiar with the NUPIC website, what to expect during the week of the audit, and how to address any audit findings, as applicable.

Kavanagh 3 Mr. Yamir Diaz-Castillo, Reactor Operations Engineer, NRR/DRO/IQVB, delivered the presentation Assessment by Licensees, Applicants, and Suppliers of Laboratories Owned by the U.S. Department of Energy (ADAMS Accession No. ML22137A176). Mr. Diaz-Castillo covered the relationship between the DOE and the national laboratories owned by DOE (e.g.,

Idaho National Laboratory, etc.). Mr. Diaz-Castillo clarified that while DOE owns the national laboratories, these facilities are operated by contractors and the employees of the laboratories are not Federal employees. As such, the national laboratories are not considered to be a Federal agency. Mr. Diaz-Castillo clarified that because the national laboratories are not considered to be a Federal agency, when procuring items and services that will be used in a safety-related application; licensees, applicants, and suppliers are responsible for: (1) verifying the effective implementation of the laboratories programmatic quality controls, and (2) maintaining responsibility for 10 CFR Part 21.

At the end of Mr. Diaz-Castillos presentation, Ms. Kavanagh began the first Q&A session for any of the attendees to ask any questions to the presenters or to the NRC staff on any topics related to quality assurance and/or vendor inspections. Ms. Kavanagh concluded the first day of the workshop by thanking all the attendees for their participation.

Day 2: June 2, 2022 Ms. Kavanagh welcomed the attendees to the second day of the 2022 NRC 8th Vendor Workshop and introduced the next presenter.

Mr. Doug Bollock, Senior Reactor Operations Engineer, NRR/DRO, Reactor Oversight Process Inspection Branch, delivered the presentation Commercial-Grade Dedication Inspections at Licensees (ADAMS Accession No. ML22137A276). Mr. Bollock provided information on the planned commercial-grade dedication inspections that will replace the power-operated valve (POV) inspections starting in January 2023. Mr. Bollock clarified that these inspections will be performed under the Reactor Oversight Program baseline inspection program and will be similar to Environmental Qualification, Fire Protection, and POV inspections. Mr. Bollock provided details about the inspections such as the expected length of the inspection, team composition, inspection procedures that will be used, how many samples per inspection, etc. Mr. Bollock stated that the NRC staff is open to holding public meetings in the Fall of 2022 to discuss the preparation and implementation for the inspections with the nuclear industry.

Mr. Yiu Law, Reactor Operations Engineer, NRR/DRO/IQVB, delivered the presentation NUPIC Audit Team & Supplier Interface Before, During, and After the Audit (ADAMS Accession No. ML22137A292). Mr. Laws presentation focused on how the NRC adapted and made decisions for performing vendor inspections during the COVID-19 pandemic. Mr. Law mentioned how the NRC developed a strategy for determining how to conduct vendors inspections, whether a remote or hybrid inspection is an option, and how it continues to perform a weekly COVID-19 assessment to help inform the decision of whether to perform the inspection or not. Mr. Law provided a list of lessons learned from performing inspections during a pandemic.

Mr. Marc Tannenbaum, Senior Technical Executive, EPRI, delivered the presentation Implementation of the Electric Power Research Institutes (EPRI) Guidance on Hybrid &

Remote Assessments (ADAMS Accession No. ML22137A279). Mr. Tannenbaum focused his presentation on describing how to implement EPRI 3002020796, Remote Assessment Techniques: Planning and Conducting Audits and Surveys Using Remote Techniques During

K. Kavanagh 4 Exigent Conditions, dated April 15, 2021. EPRI 3002020796 contains guidance on performing fully remote, provisional remote, and hybrid audits and surveys. Mr. Tannenbaum covered the assessment activities, remote techniques, performance-based approach, eligibility requirements, selection process, and lessons learned.

Mr. Mark Coren, Vendor Quality Manager, Duke Energy, delivered the presentation Duke Energy

- Remote Source Verification/Surveillance, Remote & Hybrid Assessments (ADAMS Accession No. ML22137A286). Mr. Coren provided Duke Energys experience from performing both remote source verification/surveillance as well as remote and hybrid assessments during the COVID-19 pandemic. Mr. Coren explained how Duke Energy implemented these activities as well as lessons learned.

At the end of Mr. Corens presentation, Ms. Kavanagh began the second Q&A session for any of the attendees to ask any questions to the presenters or to the NRC staff on any topics related to quality assurance and/or vendor inspections. Ms. Kavanagh concluded the second and final day of the workshop by thanking all the attendees for their participation and announcing that the NRC hopes to host the next NRC Workshop on Vendor Oversight in 2024 in person.

Summary and Conclusions Answers to questions led to discussion after each session throughout the workshop. Currently, the NRC staff is not planning to provide additional written responses to these answered questions on the public website. Interested parties who would like further clarification on any of the topics discussed during the workshop are encouraged to utilize the Frequently Asked Questions section of the NRCs public website (https://www.nrc.gov/reactors/new-reactors/oversight/quality-assurance/qual-assure-faqs.html).

To enhance the next vendor workshop, the NRC solicited suggestions and feedback from the attendees. The consensus was that the attendees appreciated the NRC being proactive in explaining its regulations and expectations for nuclear vendors. In addition, the attendees expressed interest in the NRCs continued conduct of similar outreach activities.

In summary, the workshop brought together regulated utilities, government agencies, nuclear vendors, and other interested stakeholders to discuss issues such as the NRC staff's response to the OIGs report on CFSI; (2) NUPICs audit team & supplier interface before, during, and after the audit; (3) required assessment of laboratories owned by the U.S. DOE; (4) commercial-grade dedication inspections at licensees; (5) lessons learned from inspecting during a pandemic; (6) implementation of the EPRI guidance on hybrid and remote assessments; and (7) lessons learned from implementing the EPRI guidance on hybrid and remote assessments.
