Dear Dir. Warden:

Enclosed is an application (XSNM3828), received April 15, 2022, by the U.S. Nuclear Regulatory Commission, from ALARA Logistics LLC as an Agent for SCK CEN. The application requests the export of high enriched uranium in the form of driver fuel assemblies, containing up to 105.4 kilograms (kgs) of uranium-235 contained in a maximum of 113.2 kgs of uranium enriched to a maximum of 93.20 weight percent, for fuel reload at the BR2 research reactor in Belgium.

This application requires both Commission review and Executive Branch review in accordance with 10 CFR 110.40(b)(2) and 110.41(a)(2), respectively. Assurances from EURATOM that the material will be subject to all the terms and conditions of the agreement for cooperation are also required. Additionally, since this application involves the export of high enriched uranium for use as a fuel in a research reactor, the licensing criteria in 110.42(9)(i) also apply. Therefore, before taking action on this application, we kindly request your assistance in obtaining the necessary Executive Branch views, the EURATOM assurances, and information to inform whether the 110.42(9)(i) criteria can be met.
