U.S. Nuclear Regulatory Commission Public Meeting Summary Dated: 5-13-2022

Title:

Public Meeting to Discuss Public Comments on Draft Regulatory Guide (DG)-1402 Meeting Date: April 13, 2022 Location: Webinar Category: Comment Gathering Meeting Purpose of the Meeting: The purpose of this meeting was to gather comments from external stakeholders before formal submission of written comments to the U.S. Nuclear Regulatory Commission (NRC) regarding DG-1402, "Dedication of Commercial-Grade Digital Instrumentation and Control Items for Use in Nuclear Power Plants. The NRC requested public comments on DG-1402 via Federal Register Notice 87 FR 15456 on March 18, 2022.

General Details: This was a comment gathering meeting in which attendees had an opportunity to participate with the NRC performing its regulatory function and discussing regulatory issues. The meeting was open for public comments.

Summary of NRC Presentation: The NRC staff informed the meeting participants that the comment period on DG-1402 would end on April 18, 2022. The NRC staff then presented a technical overview of DG-1402. The staff indicated that the primary scope of DG-1402 is to endorse, with clarifications, NEI 17-06, Rev. 1, Guidance on Using IEC 61508 SIL Certification to Support the Acceptance of Commercial Grade Digital Equipment for Nuclear Safety Related Applications. The staff provided a summary of these clarifications with the rationale behind each of the clarifications.

Summary of Public Feedback: Nuclear Energy Institute (NEI) gave verbal feedback related to DG-1402 as follows: 1) Expressed concern on item 1.b in DG-1402, Section C limiting dedicating entitys reliance on dedication activities performed by others, 2) Clarified that IEC-61508 only provides criteria for safety integrity level (SIL) and does not provide a certification process, 3) Clarified that certifying bodies perform commercial grade services, 4) Clarified that NEI 17-06 addresses requirements for certifying bodies versus IEC-61508, and

5) Expressed concern regarding DG-1402 specifying a 3 year frequency for evaluating accreditations of certifying bodies. NEI would formally submit their comments and the NRC indicated that they would evaluate and address NEI comments after that submittal. NEI was the only external stakeholder to engage the NRC on DG-1402 during the meeting. The NRC welcomed the submission of any additional comments from meeting participants via Federal Register Notice 87 FR 15456.

Action Items/Next Steps: NEI will formally submit their comments on DG-1402 by the end of the comment period. The staff shared the milestones for DG-1402 with the aim of issuing it as new Regulatory Guide (RG) 1.250 by fall 2022. The staff notes that the only formal comments submitted on DG-1402 were from NEI. The NRC will review the formal comment submittal, develop responses, and pursue the finalization of the staffs guidance as RG 1.250.
