ACCEPTANCE REVIEW OF REQUEST FOR REVIEW AND ENDORSEMENT OF NEI-22 GUIDELINES FOR WEATHER-RELATED ADMINISTRATIVE CONTROLS FOR SHORT DURATION OUTDOOR DRY CASK STORAGE OPERATIONS (CAC NO. A33009, EPID: L-2022-NFO-0008) - REQUEST FOR SUPPLEMENTAL INFORMATION

Dear Rodney McCullum:

By letter dated February 16, 2022 [Agencywide Documents Access and Management System (ADAMS) Accession No. ML22048A581], the Nuclear Energy Institute (NEI) submitted to the U.S. Nuclear Regulatory Commission a request for review and endorsement of NEI 22 Guidelines for Weather-Related Administrative Controls for Short Duration Outdoor Dry Cask Storage Operations.

The staff has performed an acceptance review of your proposed guidance and determined that the guidance does not provide sufficient technical information to begin a detailed review and that supplemental information is needed. The information needed to continue our review is described in the request for supplemental information (RSI) in the enclosure to this letter.

In order to determine if the guidance contains sufficient technical information to begin our technical review and establish a schedule, responses to the enclosed RSI should be provided within 30 days from the date of this letter. If NEI is unable to meet this response date, please notify us at least one week prior to the due date of your new submittal date and the reasons for the delay. If NEI is not able to respond within this timeframe or the RSI responses do not provide sufficient information, the proposed guidance may not be accepted for review.

As documented in the April 12, 2022 letter (ADAMS Accession No. ML22076A256), if NEI revises NEI 22- 02 due to the NRCs RSI, NEI may choose to resubmit NEI 22- 02 for an endorsement review and request a subsequent fee exemption request for NRC review activities in the future if it meets the requirements in 10 CFR 170.11. If a future fee exemption is requested, it will be processed based on the criteria in 10 CFR 170.11.
