PENN STATE UNIVERSITYANNUAL SELF-GUARANTEE FOR SPECIAL NUCLEAR MATERIALS LICENSE SNM-95 (ENTERPRISE PROJECT IDENTIFICATION CODE: L-2022-DFB-0000)

Dear Joseph J. Doncsecz:

By letter dated December 17, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML21362A738), you submitted to the U.S. Nuclear Regulatory Commission (NRC) a document with a certified amount of financial assurance and associated annual self-guarantee test for Special Nuclear Materials License SNM-95 for the Pennsylvania State University (PSU). The Financial Assessment Branch of the Division of Rulemaking, Environmental, and Financial Support in the Office of Nuclear Material Safety and Safeguards conducted a technical review of the adequacy of the submittal for SNM-95.

An evaluation of the analysis for the materials license is enclosed. The NRC staff concludes that the PSU self-guarantee agreement meets the financial test criteria for a non-profit college that issues bonds. The PSU conforms to the guidance in NUREG-1757, Volume 3, Revision 1 Consolidated NMSS Decommissioning GuidanceFinancial Assurance, Recordkeeping, and Timeliness, and meets the applicable requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 30 and 10 CFR Section 70.25. Enclosed is a summary of the NRC staffs review of PSUs submittal.

As a reminder for the 2022 submittal, the self-guarantee must be submitted within 90 days of the close of the fiscal year. The requirements are established by the Final Decommissioning Planning Rule and the guidance provided in NUREG-1757, Volume 3, Revision 1.

In accordance with 10 CFR Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and the enclosure will be available electronically for public inspection in the NRC Public Document Room (PDR) or from ADAMS.
