ALL AGREEMENT STATES, CONNECTICUT, INDIANA NRC NMSS, NRC REGIONS I, III, AND IV NOTIFICATION OF THE ISSUANCE, AND OPPORTUNITY TO COMMENT ON THE INTERIM PROCEDURE SA-300, REPORTING MATERIAL EVENTS, AND THE INTERIM HANDBOOK ON NUCLEAR MATERIAL EVENT REPORTING FOR THE AGREEMENT STATES (STC-22-033):
Purpose:
This communication serves two purposes: 1) to inform the National Materials Program (NMP) community (Agreement States and U.S. Nuclear Regulatory Commission (NRC)) that the above Office of Nuclear Material Safety and Safeguards (NMSS) State Agreements (SA) procedure and its Handbook have been approved for interim use; and (2) to provide the NMP community an opportunity to comment on these interim documents.
Background:
The SA-300 procedure and its Handbook were revised per the periodic revision frequency. Since the last revision, the NRC staff had noted inconsistencies within the Handbook that had led to confusion during Agreement State implementation. These inconsistencies were addressed.
Appendix A, NRC Regulatory Reporting Requirements, was significantly revised. It had been identified that tables in the Appendix caused some Agreement States to miss a report or to use the wrong reporting method. Icons were added to these tables to note whether a notification to the NRC Headquarters Operations Center or a written report to the Nuclear Material Event Database was required. These tables were revised to reflect the complexities in the regulations and no longer provide a high-level overview.
Appendix C, Event Reporting Schedule, was removed. It was identified that the table included language that was in addition to the NRC regulations. The additional language led to confusion.
The table was replaced with Appendix C, Reporting Methods and Contact Information. The new table is more concise and straightforward.
Appendix G, Radionuclides of Concern, was removed. This chart was replaced by a reference to Title 10 of the Code of Federal Regulation (10 CFR) Part 37, Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material, Appendix A, Category 1 and Category 2 Radioactive Materials.
Reporting requirements included in EA-05-090, Orders Imposing Increased Controls, Attachment B, Increased Controls for Licensees that Possess Sources containing Radioactive Material Quantities of Concern (ADAMS Accession No. ML053130364) were removed. This content was superseded by 10 CFR 37.57, Reporting of Events, and 37.81, Reporting of Events.
Discussion: This letter notifies the NMP community that the SA-300 procedure and its Handbook have been revised and issued for use on an interim basis. An interim period of 6 months should allow NRC and Agreement State staff in the NMP community to provide August 3, 2022 STC-22-033 2 comments1 based on their review of the procedure, or from improvements identified during implementation. The regulations for event reporting have not changed. During the interim period, the interim procedure and its Handbook will be used during the Integrated Materials Performance Evaluation Program reviews. Reporting of Agreement State nuclear material licensee events to the NRC is mandatory for purposes of compatibility. The Technical Quality of Incident and Allegations Activities will rely on compliance with the regulations and the subsequent reporting to the NRC of Agreement State licensee events.

Changes within the interim SA-300 procedure and its Handbook will be discussed during the Organization of Agreement State meeting in August 2022.
The comment period was developed following consultation with the Organization of Agreement States and ends on February 3, 2023. If there are no comments by the NMP community, then the procedure will automatically become final on May 3, 2023, without any further action.
