Dear Ms. Steves:

We have reviewed the three Kansas non-standard well logging license conditions received by our office on November 3, 2021, and as supplemented on November 19, 2021 and January 31, 2022. These requirements were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the legally binding requirements with you and David Lawrenz on February 9, 2022.

Based on the November 3 and 19, 2021, and January 31, 2022 emails and our discussions with you on February 9, we understand that Kansas is proposing to condition a newly licensed well-owner to allow possession of a well-logging source (300 mCi of Scandium-46) that cannot be recovered from the salt storage cavern. We also understand that the license is expected to be short-lived and the conditions temporary to allow the source to naturally decay to background levels that would allow the license to be terminated. We also understand that the well-owner became the licensee because the initial licensee, the well-logger, transferred the source to the well-owner. Finally, we also understand that Kansas plans to approve an exemption along with the three non-standard license conditions that will compy with Kansas equivalent of 10 CFR 39.91, Applications for exemptions, only after determining that the circumstances surrounding the request are urgent and temporary and that an exemption will not endanger life, property, or the common defense and security; and that it is otherwise in the public interest.

Please inform us if any of our understandings are incorrect.

As a result of our review, we have three comments for consideration and inclusion in the license conditions for specificity, clarity, and adherence to health and safety requirements. These are identified in the enclosure. Please note that we have limited our review to the legally binding requirements required for compatibility and/or health and safety. We have not reviewed the Kansas licensing process for the newly licensed well-owner..

We request a copy of the three non-standard license conditions that are revised to address our comments be provided for our review . As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Kansas, in response to our comments, and provide a copy to Division of Material Safety, State, Tribal, and Rulemaking Programs, NMSS.

Kansas should specify what monitoring is being requested for the licensee to perform if different from the requirements in the regulations,or cite the regulation/license condition which specifies the monitoring/survey requirements.

Also, the wording of the license condition is confusing in that it states, any action taken for each of the following:

A. Annually thereafter for a period of three (3) years.

B. After completion of Item A of this condition, the monitoring period may be extended to each five (5) years with approval of the department.

Specify what actions you are requesting or referring to for A. and B.

Do you mean to say each five years, or just five years since the radionuclide should have decayed to

If this license condition is exempting the licensee from the requirements in Kansas equivalent regulations to 10 CFR 39.77(a), it should require the licensee to notify the department immediately, instead of within 24 hrs. to meet the Compatibility Category C designation assigned to 10 CFR 39.77(a).

Also, the license condition should specify which regulation(s) you are exempting the licensee from.
