State Consultation - Draft No Significant Hazards Determination Regarding an License Amendment Request for NextEra Energy Duane Arnold, LLC, Duane Arnold Energy Center ISFSI in Palo, Iowa

Angela Leek, Bureau Chief Bureau of Radiological Health Iowa Department of Public Health Lucas Office Bldg., 5th Floor 321 East 12th Street Des Moines, IA 50319 Hello Ms. Leeks, By letter dated February 19, 2021 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML21050A189), as supplemented on January 3. 2022 (ADAMS Accession No. ML22004A010 (Pkg)), NextEra Energy Duane Arnold, LLC submitted an amendment request for the Duane Arnold Energy Center (DAEC). The amendment application consists of proposed revisions to the Renewed Facility Operating License and the Technical Specifications (TS). These proposed revisions would reflect the removal of all spent nuclear fuel from the DAEC spent fuel pool and its transfer to dry cask storage within an onsite Independent Spent Fuel Storage Installation (ISFSI).

These proposed changes would more fully reflect the permanently shutdown status of the decommissioning facility, as well as the reduced scope of structures, systems, and components necessary to ensure plant safety once all spent fuel has been permanently moved to the DAEC ISFSI, an activity which is currently scheduled for completion in mid-2022. The proposed changes also include the relocation of administrative controls from the TS to the DAEC Quality Assurance Topical Report, as well as deletion of the remaining TS Bases, except for the environmental monitoring reporting requirements which are required per Title 10 of the Code of Federal Regulations (10 CFR) 50.36a(a)(2).

The Commission issued proposed finding that the amendment application involves no significant hazards consideration published in the Federal Register on April 20, 2021 (86 FR 20526), see attached,. The proposed no significant hazard determination is addressed by the licensee in its application dated February 19, 2021. I am providing a copy of the Federal Register Notice (FRN), attached, per 10 CFR 50.91 (b)(2). The supplemental information provided by the license on January 3, 2022 does not change the scope nor the NRC staffs proposed no significant hazards consideration determination published on April 20, 2021.

We are considering finalizing this determination. Also, we believe a Categorical Exclusion would apply.

If the State of Iowa has comments on this license amendment request or our proposed no significant hazards determination, please e-mail me your comments by Close of Business January 31, 2022. If you do not have comments, I would appreciate it if you would please provide an email that you have no comments by COB Jan 31, 2022.
