U.S. NUCLEAR REGULATORY COMMISSIONS ANALYSIS OF GE HITACHI NUCLEAR ENERGYS DECOMMISSIONING FUNDING STATUS REPORT FOR THE SHUTDOWN POWER REACTORS AT THE VALLECITOS NUCLEAR CENTER, DOCKET NOS 50-18 AND 50-183

Dear Mr. Murray:

By letter dated April 1, 2021, the U.S. Nuclear Regulatory Commission (NRC) received your decommissioning funding status (DFS) report (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21092A056) for the shutdown power reactors Vallecitos Boiling Water Reactor (VBWR), Docket 50-18, and for the Empire State Atomic Development Associates Vallecitos Experimental Superheat Reactor (EVESR),

Docket 50-183, at the Vallecitos Nuclear Center. By letter dated October 21, 2021, the NRC transmitted a request for additional information (RAI) in relation to your DFS report (ADAMS Accession No. ML21285A179). You responded to the NRCs RAI by letter dated November 17, 2021 (ADAMS Accession No. ML21321A114).

The NRC has reviewed and analyzed the site-specific decommissioning cost estimate, as required in Title 10 of the Code of Federal Regulations (10 CFR) 50.82(a)(4)(i), and the amount(s) stated within the licensees surety bond riders for the above plants. Based on the surety bond amounts, the NRC has determined that as of December 31, 2020, GE Hitachi Nuclear Energy (GEH) is providing a total amount of decommissioning funding assurance in the amount of $15.58 million for the VBWR and in the amount of $15.85 million for the EVESR.

This letter confirms the correspondence, described above, regarding DFS reports for permanently shut down power reactors as required under 10 CFR 50.82(a)(v) - (vi). As of the date of this letter, considering the available information, the NRC has determined that GEH has satisfied the decommissioning funding assurance requirements of 10 CFR 50.82, Termination of License, for VBWR and EVESR on December 31, 2020. A summary report completed by NRC staff reflecting decommissioning power reactor DFSs is expected to be completed and made publicly available by the end of calendar year 2021.
