SUMMARY

OF DECEMBER 7, 2021, PUBLIC MEETING TO DISCUSS RESPONSES TO COMMENTS RECEIVED ON THE DRAFT ACCIDENT TOLERANT FUEL PROJECT PLAN, VERSION 1.2 On December 7, 2021, the U.S. Nuclear Regulatory Commission (NRC) staff conducted an observation public meeting with representatives from the nuclear industry to discuss comments received on the Draft Version 1.2 of the NRCs Accident Tolerant Fuel (ATF) Project Plan, which can be found at Agencywide Documents Access and Management System (ADAMS) Accession No. ML21243A298. The NRC staffs letter to the Nuclear Energy Institute (NEI) containing the staffs responses to comments on the ATF Project Plan can be accessed at ADAMS Accession No. ML21314A531. The meeting notice and meeting slides can also be found at ADAMS Accession Nos. ML21326A160 and ML21341A003, respectively.

The NRC staff first provided an overview presentation of the ATF Project Plan, Version 1.2, to include the changes between the draft and final versions. The NRC staff noted that one change from the draft version was that the Regulatory Framework Applicability Analysis (previously Appendix A) and the Licensing Pathway Diagrams (previously Appendix B) were removed from the main body of the Project Plan and that the staff is working to finalize a separate document.

The NRC staff also presented general comments received on the draft ATF Project Plan and the subsequent NRC responses. Lastly, the NRC staff discussed next steps and reinforced the importance of stakeholder engagement.

Following the completion of the staffs presentation, the NRC staff opened the meeting to solicit stakeholder feedback. During this portion of the meeting, individuals from industry asked multiple questions.

A member from industry asked if there is any additional information regarding timeline for when NRC can share information related to its plan to evaluate environmental impacts with the public or industry. The NRC responded that staff is working on a schedule, which will be made available for public review.

D. Wrona In response to the NRC staffs discussion of continued stakeholder engagement, an individual queried as to what additional schedule information the NRC is looking for from industry. The NRC responded that continued efforts are underway to ensure that the agency is responsive to industry requests, and that any additional schedule-related information will help the agency with resource planning.

A question was posed regarding how the NRC staff plans to publish the Regulatory Framework Applicability Analysis (Appendix A) and the Licensing Pathway Diagrams (Appendix B). The NRC staff discussed that the plan is for the appendices to be maintained as working documents that will be posted to the NRCs public website and updated on an as-needed basis.

There was a discussion regarding risk-informed applications and approaches to nuclear fuel licensing. The NRC staff mentioned that some risk informed applications could potentially conflict with NRC policy, and that the term risk-informed approach is a high-level concept that could incorporate a range of issues that will need to be fully evaluated.

A request was made to potentially discuss policy implications during a separate meeting.

An individual asked if there is going to be a public opportunity to review the document containing the separated appendices before publishing. The NRC responded that the intent was not to formally issue the document for public review before finalizing, as it will be a working document, updated as needed.

No comments were received during the public comment portion of the meeting and no regulatory decisions were made during the meeting.
