Market Street Akron, Ohio 44308 330-436-1380 10 CFR 50.71 In accordance with 10 CFR 50.71(b), each licensee shall submit upon issuance its annual financial report, including the certified financial statements, to the Commission unless the licensee submits a Form 10-Q with the Security and Exchange Commission or a Form 1 with the Federal Energy Regulatory Commission. Energy Harbor Corp., the parent company of Energy Harbor Nuclear Generation LLC (owner of the nuclear plants) and Energy Harbor Nuclear Corp. (operator of the nuclear plants), has not submitted either of these forms to the aforementioned commissions.
Because Energy Harbor Corp. has not issued an annual financial report of the kind typically provided pursuant to 10 CFR 50.71 (b), preliminary financial information for the fiscal period ending December 31, 2020 is being provided to satisfy the requirements of 1 0 CFR 50.71 (b). Due to ongoing legal proceedings, an external auditor is unable to certify the financial results; therefore, the results are considered to be preliminary.
Energy Harbor Nuclear Corp. hereby submits the annual financial report in the form of preliminary Unaudited Condensed Consolidated Financial Statements.
Enclosure A to this letter is an affidavit prepared in accordance with 10 CFR 2.390 requesting that the confidential commercial and financial information provided in Enclosure B be withheld from public disclosure.
Enclosure B contains information to be withheld from public disclosure under 10 CFR 2.390(a)(4). Upon removal of Enclosure B, this letter is uncontrolled.
