APPROVAL OF THE CIMARRON ENVIRONMENTAL RESPONSE TRUST REQUEST TO ALLOCATE FUNDS FOR THE COSTS FOR ADDITIONAL SERVICES TO BE PERFORMED BY ENERCON SERVICES, INC. TO SUPPORT REQUESTS FOR INFORMATION FROM THE U. S. NUCLEAR REGULATORY COMMISSION NOT ANTICIPATED FOR IN THE 2021 BUDGET

Dear Mr. Halliburton:

By letter dated November 18, 2021,1 the Cimarron Environmental Response Trust requested approval to allocate additional funds not previously approved in the 2021 Cimarron Budget.2 This letter documents the U.S. Nuclear Regulatory Commission (NRC) staffs approval of this request.

In its November 18 submittal, Environmental Properties Management (EPM) requested the NRCs approval to deviate from the approved budget. The scope of work assigned to Task 4, Site Decommissioning includes all other activities related to the preparation and implementation of the decommissioning plan. The approved budget for 2021 was based on an assumed scope of work to respond to NRC requests for information, and the actual scope was greater than had been anticipated. The scope of work assigned to Task 2, License Compliance in the 2021 approved budget includes activities related to licensing and the radiation protection and quality assurance programs, not for Enercons services in responding to the request for information from the NRC.

EPM has prepared change orders to provide additional funding for Enercons work in the following amounts:

$31,300 for activities chargeable to Task 2, License Compliance

$28,200 for activities chargeable to Task 4, Site Decommissioning 1 Agencywide Documents Access and Management System (ADAMS) Accession No ML21343A353.

Halliburton 2 EPM proposes to allocate $57,582.40 ($31,300 added to ($28,200 multiplied by 0.932)) to the Federal Account and $1,917.60 ($28,200 multiplied by 0.068) to the State Account. EPM requests NRC and the Oklahoma Department of Environmental Quality approval of its proposal.

Funding was not sufficient to complete Enercons scope of work, for the reasons described in EPMs November 18 submittal. EPM requested approval to transfer excess 2021 Cimarron Budget funding from Veolia Nuclear Solutions - Federal Services for Burns & McDonnell (for work which must be deferred due to the time required to revise the decommissioning plan (DP))

to fund Enercons scope of work.

The NRC approves of the allocation of additional funds, i.e., the deviation from the approved budget to allow Enercon to complete the changed scope of work request.

This letter does not constitute the NRCs approval of the proposed revisions to the DP, which are included in the Scope of Work section of EPMs August 28 submittal. When EPM submits the revised DP, the NRC will complete an acceptance review and, if the NRC accepts the DP for detailed technical review, then the NRC will make a DP approval determination after completion of its detailed technical review.

In accordance with Title 10 of the Code of Federal Regulations Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS.
