Dear Mr. Warden:
Enclosed is an application (XSNM3826), accepted by the U.S. Nuclear Regulatory Commission on November 17, 2021, from the National Nuclear Security Administrations New Brunswick Laboratory. The application requests to export five Certified Reference Materials (CRMs) for use in nuclear safeguards applications at the International Atomic Energy Agencys (IAEA) laboratory in Seibersdorf, Austria. The five CRMs contain special nuclear material as follows:
0.030 kilograms (kg) plutonium (93% Pu-239), 0.050 kg uranium metal (94% enriched), 1.5 kg uranium oxide (UO2) fuel pellets (4% enriched), 0.100 kg uranium oxide (U3O8) powder (97%
enriched), and 0.010 kg plutonium (50% Pu-239).
Consistent with the criterion in 10 CFR 110.41(a)(2), we would appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the requested export meets the applicable criteria in the Atomic Energy Act of 1954, as amended. We would also appreciate your assistance in obtaining the necessary assurances from the IAEA.
