Dear Ms. Shults:

We have reviewed the proposed revisions to the Tennessee Regulations for Protection Against Radiation Chapters 0400-20-04, 0400-20-05, 0400-20-07, 0400-20-08, 0400-20-10, 0400 12, and 0400-20-13, received by our office on October 21, 2021. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1, 2018-2, 2018-3, 2019-1, 2019-2, 2020-1, 2020-2, and 2020-3 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with Andrew Holcomb on November 8, 2021.

As a result of our review, we have nine comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. Under our current procedure, a finding that the Tennessee regulations meet the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final Tennessee regulations. However, we have determined that if your proposed regulations were adopted, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the final changes, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other Tennessee regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. TN needs to make the correction indicated above to meet the Compatibility Category B designation assigned to 10 CFR 30.34(g).

Training for Radiation Safety Officer and Associate Radiation Safety Officer 10 CFR 35.50(b)(2) states in part, The written attestation must state that the individual has satisfactorily completed the requirements in paragraphs (b)(1) and (d) of this section, and is able to independently. TNs equivalent sections to 35.50(b)(1) and (d) are sections 0400-20-07.23(2)(a) and (4),

respectively; however TN includes other regulations, i.e., (2)(b), and (3)(a) and (b). that are not referenced in 10 CFR 35.50(b)(2).

TN needs to omit the incorrect references as stated above to meet the Compatibility Category B designation assigned to 10 CFR 35.50.

3 0400-20.24(1),

(1)(b)1 and (2)(b) 35.51 2018-1 B

Training for an authorized medical physicist 10 CFR 35.51(a) states in part, (a) Is certified by a specialty board whose certification process has been recognized by the Commission or an Agreement State and. TNs equivalent regulations omit the phrase, whose certification process.

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS TN needs to include the phrase indicated above to meet the Compatibility Category B designation assigned to 10 CFR 35.51.

4 0400-20.25(1) and (2)(b) 35.55 2018-1 B

Training for an authorized nuclear pharmacist 10 CFR 35.55(b)(2) states in part, (2)

Has obtained written attestation, signed by a preceptor authorized nuclear pharmacist, that the individual has satisfactorily completed the requirements in paragraph (b)(1) of this section and is able to independently. TNs equivalent regulation to 35.55(b)(1) is section 0400-20-07.25(2)(a); however TN includes other regulations, i.e., (1)(a) through (d), that are not referenced in 10 CFR 35.55(b)(2).

TN needs to omit the incorrect references stated above to meet the Compatibility Category B designation assigned to 10 CFR 35.55.

5 0400-20.26 35.57 2018-1 B

Training for experienced Radiation Safety Officer, teletherapy or medical physicist, authorized medical physicist, authorized user, nuclear pharmacist, and authorized nuclear pharmacist 10 CFR 35.57(b)(1) states, (b)(1)

Physicians, dentists, or podiatrists identified as authorized users for the medical use of byproduct material on a license issued by the Commission or an Agreement State, a permit issued by a Commission master material licensee, a permit issued by a Commission or an Agreement State broad scope licensee, or a permit issued by a Commission master material license broad scope permittee on or before January 14, 2019, who perform only those medical uses for which they were authorized on or before that date need not comply with the training requirements

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS of subparts D through H of this part.

TN omits the following from their equivalent regulations:

a) the words, on or, and or before as highlighted above; b) certain equivalent regulations to those included in subparts D through H, i.e., 35.100, 35.200, 35.310, 35.315, 35.404, 35.406, 35.410, 35.415, 35.432, and 35.457; and c) the equivalent provision to 10 CFR 35.57(b)(3).

TN needs to make the changes indicated above to meet the Compatibility Category B designation assigned to 10 CFR 35.57.

6 0400-20.39 (1) 35.190 2018-1 B

Training for uptake, dilution, and excretion studies 10 CFR 35.190(c)(2)(i) states in part, (i) A preceptor authorized user who meets the requirements in §§ 35.57, 35.190, 35.290, or 35.390, or equivalent Agreement State requirements; or (ii) A residency program director who affirms in writing that the attestation represents the consensus of the residency program faculty where at least one faculty member is an authorized user who meets the requirements in §§ 35.57, 35.190, 35.290, or 35.390, or. TN cites section 0400-20-07-.26 as their equivalent regulation to 35.390; however the correct regulation is 0400-20-07-.47.

TN needs to correct the references as stated above to meet the Compatibility Category B designation assigned to 10 CFR 35.190.

TN needs to make the change indicated above to meet the Compatibility Category B designation assigned to 10 CFR 71.97.

8 0400-20.05(3) 34.47 2020-1 C

Personnel monitoring TN omits the following statement from their equivalent provision to 10 CFR 34.47(d):

For personnel dosimeters that do not require processing, evaluation of the dosimeter must be started within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />.

TN needs to add the above to meet the Compatibility Category C designation assigned to 10 CFR 34.47(d).

9 0400-20.20(1) 39.65 2020-1 C

Personnel monitoring devices TN omits the following highlighted phrase from its equivalent regulation to 10 CFR 39.65(a):

(a) The licensee may not permit an individual to act as a logging supervisor or logging assistant unless that person wears a personnel dosimeter at all times during the handling of licensed radioactive materials.

TN needs to add the phrase indicated above to meet the Compatibility Category C designation assigned to 10 CFR 39.65.
