Notice of Termination of Provisional Trust Agreement Holtec Decommissioning International (HDI), on behalf of Holtec Indian Point 2, LLC (Holtec IP2), respectfully provides notice of plans to terminate the Entergy Indian Point 2 Provisional Decommissioning Agreement for Indian Point Nuclear Generating Units 1 and 2, dated August 30, 2001 (Provisional Trust Agreement), which governs a provisional decommissioning trust (the Provisional Trust) for Indian Point Nuclear Generating Station, Units 1 and 2 (IP1 and IP2).
On December 31, 2021, funds in the Provisional Trust will be expended for purposes of decommissioning IP1 and IP2. Pursuant to Article V, Section 5.01(i) of the Provisional Trust Agreement, the Provisional Trust shall terminate on the date that all assets and property of the Provisional Trust have been distributed.
Pursuant to License Condition 6(b)(iv) of the IP1 Provisional Operating License and License Condition 3(b)(iv) of the IP2 Renewed Facility Operating License, and Section 9.05(d) of the Provisional Trust Agreement, HDI hereby gives thirty (30) business days prior written notice of the termination of the Provisional Trust and Provisional Trust Agreement. This termination does not affect the funds governed by the Entergy Indian Point 2 Master Decommissioning Trust Agreement, which includes the Unit 1 Qualified Fund, the Unit 1 Nonqualified Fund, the Unit 2 Qualified Fund, and the Unit 2 Nonqualified Fund (IP1&2 Funds). The IP1&2 Funds will continue to provide reasonable assurance of funding for remaining decommissioning of IP1 and IP2.
