Upon consideration of the October 26, 2021 opposition of applicant Duke Energy Corp.

(Duke) to the October 26, 2021 partially unopposed motion of petitioners Beyond Nuclear, Inc.,

and the Sierra Club, Inc. (collectively Petitioners) to extend by seven days the October 29, 2021 deadline for their reply to the October 22, 2021 answers of Duke and the Nuclear Regulatory Commission (NRC) Staff to Petitioners September 27, 2021 hearing request,1 and finding that (1) existing filing schedules established in accord with 10 C.F.R. § 2.309(i) require Petitioners sole counsel to simultaneously prepare and submit within three days of each other responsive pleadings addressing a total of 110 plus pages of filings by the Staff and the applicants in this and another subsequent license renewal (SLR) proceeding currently pending on appeal before 1 Applicants Answer Opposing Petitioners Motion for Extension of Time to Reply (Oct. 26, 2021); see Petitioners Partially Unopposed Motion for Extension of Time to Reply to Oppositions to Hearing Request and Waiver Petition (Oct. 26, 2021) at 1 (indicating that the motion is not opposed by the NRC Staff but Duke objects to the extension request).

the Commission;2 and (2) this situation establishes the requisite unavoidable and extreme circumstances for such a relatively brief extension that will accommodate a timely filing in the Commission proceeding and will not result in any ascertainable impact on the overall schedule for this proceeding,3 it is ORDERED, that for good cause shown, Petitioners motion for extension of time is granted in that Petitioners reply to the Duke and NRC Staff answers to their hearing petition is now due on or before Friday, November 5, 2021.
