Response: Request: Guidance for SMRs Date: Friday, September 10, 2021 4:07:00 PM Mr. Osborn, On May 12, 2020, the NRC published in Volume 85 of the Federal Register (FR) (85 FR 28436 and 85 FR 44025), the proposed rule, Emergency Preparedness (EP) for Small Modular Reactors (SMR) and Other New Technologies (ONT), for a 75day public comment period. Along with the proposed rule, the NRC requested public comments on draft guide (DG), DG-1350, Performance-Based Emergency Preparedness for Small Modular Reactors, Non-Light-Water Reactors, and Non-power Production or Utilization Facilities.
The final version of DG-1350 will be the only new guidance associated with EP for SMR and ONT to be developed at this time. Currently available guidance associated with emergency preparedness was included in the proposed rule. The draft final rule is scheduled to be provided to the Commission for approval by December 30, 2021. The status of the EP SMR & ONT rulemaking is available in NRC web site: https://www.nrc.gov/reading-rm/doc-collections/rulemaking-ruleforum/active/ruleindex.html On May 19, 2021, the University of Illinois at Urbana Champaign submitted a letter, Notice of Intent to Submit an Application for a Construction Permit for a Research & Test Reactor (Agencywide Documents Access and Management System Accession No. ML21153A059). According to the letter, the University intends to apply for a facility operating license for a research and development facility under Section 104c of the Atomic Energy Act of 1954, as amended. This type of facility may not be subject to all of the requirements in the proposed rule related to SMRs and ONTs.
