The U.S. Environmental Protection Agency (EPA) has published a notice in the Federal Register confirming its receipt of the U.S. Nuclear Regulatory Commissions (NRCs) Final Environmental Impact Statement (FEIS) for the Interim Storage Partners, LLC license application for a consolidated interim storage facility (CISF) for spent nuclear fuel and Greater Than Class C radioactive waste in Andrews County, Texas. The EPAs notice is accessible using the following link:
The NRC staff made the FEIS publicly available on July 29, 2021. The FEIS is accessible using the following direct link: https://www.nrc.gov/docs/ML2120/ML21209A955.pdf, and from the NRC public webpage for the ISP CISF application at https://www.nrc.gov/waste/spent-fuel-storage/cis/waste-control-specialist.html.
An NRC licensing decision concerning the proposed CISF is expected by the end of September 2021. A licensing decision cannot be made until 30 days after the publication of EPAs Federal Register notice.

Dear Mr. Humphreys,
Regarding your first question, if licensed, the proposed CISF could only store spent nuclear fuel using the storage systems authorized in the license. As discussed in section 2.2.1.2 of the EIS, ISP is requesting approval to store fuel using the dry cask storage systems
designed by TN Americas and NAC International. If the NRC license is granted to ISP, ISP could only use these two systems. At some future time, ISP could request an amendment to the license to store spent nuclear fuel using a different dry cask storage system design; that amendment request would receive NRCs detailed technical review at that time.
Under Section 309 of the Clear Air Act, EPA reviews and comments on draft EISs and reviews final EISs to ensure that its comments on the draft EISs were taken into account.
EPA may provide additional comments on the final EISs as a result. It is my understanding that EPA posts notices in the Federal Register each Friday, to identify the draft and final EISs filed with EPA in the preceding week. I will let you when EPA notices its receipt of the ISP CISF final EIS. EPAs review process for draft and final EISs is found on the internet at www.epa.gov/nepa/epa-review-process-under-section-309-clean-air-act. EPA did review the ISP CISF draft EIS and had no comments.

- Jim,
I have a couple of questions concerning the final EIS for the proposed ISP CISF that I was hoping you could answer for me:
- 1. Its my impression that if the CISF is licensed as described in the EIS, Holtec dry casks could not be stored there. Is that correct?
- 2. The attached doc indicates that the final EIS will go to the EPA for publishing in the Fed Register. I am not familiar with the interaction between the NRC and the EPA in your review/approval process.
Any info about the EPA process would be helpful. For example, does the EPA have to also approve the final EIS? What is the expected schedule for the EPA to publish the final EIS evaluation in the Fed Register? etc.
Any info that you could supply would be helpful.
