PART I.B -- INFORMATION NOT LOCATED OR WITHHELD FROM DISCLOSURE We did not locate any agency records responsive to your request. Note: Agencies may treat three discrete categories of law enforcement and national security records as not subject to the FOIA ("exclusions"). See 5 U.S.C. 552(c). This is a standard notification given to all requesters; it should not be taken to mean that any excluded records do, or do not, exist.

We have withheld certain information pursuant to the FOIA exemptions described, and for the reasons stated, in Part II.

This response also serves to acknowledge receipt of your request.

Under NUREG-0190 (ML051390495), the retention period for enforcement-related records that are not deemed significant is only 10 years. We confirmed with Office of Enforcement staff that the enforcement matter you inquired about was not deemed significant so, to the extent a transcript of the Predecisional Enforcement Conference (PEC) was created, it i(along with the rest of the enforcement file,) would no longer be available. We do note that, according to the letter that may be found in public ADAMS at https://www.nrc.gov/reading-rm/doc-collections/enforcement/actions/materials/ea99080.html, it does not appear that a transcript had been created. This letter makes reference to an enclosed Notice of Violation and any response the licensee provided being available in the NRC's Public Document Room (PDR).
