SUMMARY

OF THE JULY 22, 2021, PUBLIC MEETING TO DISCUSS CHANGES TO THE ACCIDENT TOLERANT FUEL PROJECT PLAN On July 22, 2021, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a public meeting with representatives from the nuclear industry to discuss changes made in draft Revision 1.2 of the Accident Tolerant Fuel (ATF) Project Plan (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21188A117). The purpose of the meeting was to 1) provide an overview of the changes that have been made to the project plan and 2) solicit stakeholder feedback on the changes. Bo Pham, Director of the Division of Operating Reactor Licensing, and Joe Donoghue, Director of the Division of Safety Systems, both from the Office of Nuclear Reactor Regulation, made opening remarks. The NRC staffs first presentation provided a high-level overview of the changes made in draft Revision 1.2 of the project plan. The NRC staffs second presentation focused on providing an overview of the Regulatory Framework Applicability Analysis that has been added to Appendix A of the plan.

Following the completion of the staffs presentations, the NRC staff opened the meeting to solicit stakeholder feedback on changes made to the plan. Representatives from Nuclear Energy Institute (NEI) and Framatome provided feedback for the NRC staff to consider as it finalizes the project plan revision. Enclosure 1 contains the feedback received during the meeting. The

D. Wrona representative from NEI stated that the organization intended to provide additional detailed comments via letter by August 6, 2021.

Approximately 65 members of the public and representatives from the industry attended the meeting. No comments were received during the public comment portion of the meeting and no regulatory decisions were made during the meeting.

FEEDBACK RECEIVED ON DRAFT ACCIDENT TOLERANT FUEL PROJECT PLAN Source Comment Nuclear The industry sees overall positive environmental benefits (e.g., fewer Energy shipments, less amounts of uranium, etc.) and strongly encourages the U.S.

Institute (NEI) Nuclear Regulatory Commission (NRC) to evaluate environmental issues generically and update the plan to reflect.

NEI Suggest adding the use of exemptions to the licensing pathways and describe how they will be used in licensing accident tolerant fuels.

NEI There are several mentions of near-term and long-term burnup concepts. The industry sees both as near-term and request the NRC staff to clarify what is meant.

NEI The definition of High Quality refers to quantities of data. What is meant by this term? Regarding high quality, risk-informed submittal, what is it that the NRC staff thinks is important for industry to know and include?

NEI The project plan should address need for the NRC to collaborate with foreign counterparts for uranium hexafluoride overpacks.

NEI Regarding fuel fragmentation, relocation, and dispersal (FFRD), the project plan should acknowledge industrys pursuit of the alternate licensing strategy.

NEI Regarding the term FFRD burnup threshold, the NRC staff should remove the term burnup because there could be other factors that affect or determine thresholds.

NEI Regarding the term Consequences in Tasks 3 and 4 in the PRA section, the NRC staff should add a discussion about how the staff plans to address dispersal and consequences.

NEI The licensing pathway diagram shows that Advisory Committee on Reactor Safeguards review is a possible delay to approval of license amendment requests. The NRC staff should add information about how to avoid delays due to Advisory Committee on Reactor Safeguards review.

Framatome Recommend that the NRC staff perform a word search for must to ensure the use is intentional and actually reflects a requirement.
