Theproposedchange isconsistent with theguidanceinAL 95-06. Theunit staff qualifications donotsatisfy thecriteria of 10CFR50.36 for inclusion intheTS asan Administrative Control. TheDESCQAPD report isadequately controlled by other regulations andistherefore an acceptable location fortheunit staffqualification requirements.

Specifically, consistent with the guidance inAL 95-06, futurechanges to theQAPDstaff qualification requirements willbe evaluated under the10CFR50.54(a) evaluation process.

3.2 W l I

VCSNSisrequesting approvaltoeliminate thereferenced documents andassociated discussions for unit qualifications staff requirements intheTS and follow theapplicable qualification requirementscurrently provided intheQAPD.Theproposed change will eliminate between aninconsistency TS6.3 andtheQAPD.Future changes totheQAPD will becontrolled the10CFR50.54(a) via evaluation process.

3.3M DESChasevaluated theproposed amendment against thecriteriain10CFR50.92and hasdetermined that theoperation oftheVCSNSinaccordance with theproposed amendmentpresentsnosignificanthazards. TheDESCevaluation against eachofthe in10CFR50.92 criteria isprovided asanAttachment (Attachment 4) to this amendment request.

4.0 REGULATORY EVALUATION

4.1 Theproposed change hasbeenevaluated todetermine whether appi,icable regulations andrequirements)continue tobemet.Thefollowing current applicabl6 regulations and werereviewed requirements regulatory inmaking thisdetermination:

requires the provisions relatingorganization to and management, procedures, recordkeeping, review andaudit, andreporting thatarenecessary toassure operation of thefacilityina safe manner beincluded inthe TS.

10CFR50.120 10CFR50.120, "Training and Qualification ofNuclear Power Plant Personnel," requires thateachnuclear power plant licensee orapplicant for anoperator license establish, implement, andmaintain the training and qualification programs thatarederived from a systems approach to training as defined in10 CFR 55.4.

10CFRPart 55 10CFRPart 55,"Operators' Licenses," Subpart D, "Applications," requires that operator licenseapplications include information concerning an individual's education, experience, andother related matters toprovide evidence and certification that theapplicant has successfully completed thefacility licensee's trainingprogram that isbased ona systems approach totraining.

M NUREG-1021, "Operator Licensing Examination Standardsfor Power Reactors,"

Revision 11, establishes thepolicies, procedures, andpractices forexamining licensees andapplicants for reactor operator andsenior reactoroperator licenses at nuclear power reactorfacilities under 10CFRPart 55,"Operators' Licenses."

Ggic[e.14 Rgtgy.IaLor.y Regulatory Guide (RG) 1.8, "Qualification andTraining ofPersonnel for Nuclear Power describes Plants," a method that theNRCstaff finds acceptable for complying withthe NRC's regulations regarding training andqualification ofnuclear power plant personnel.

Theproposed change would eliminate theunit staff qualification requirements from the TS andmaintain thecurrent commitments toRG 1.8along with anyexceptions, alternatives,orcalculations asidentified inthecurrent QAPD.

4.2 Precedent OnMarch 1,2018, Exelon Generation Company (EGC) submitted aLAR[5.3) torelocate thelicensee's staff qualification requirements totheEGCQuality Assurance Topical Report. TheLARfrom EGCwasapplicable totheir fleet consisting ofthirteen different OnAugust facilities. 2,2018, NRCapproved theLARfrom EGCt[5.4).

4.3Conclusion

No.20-358 Serial DocketNo.50-395 Attachment 1:Page5 of5 DESC has evaluated theproposed changeagainst theapplicable regulatory requirements andacceptance criteria. DESChasdetermined thattheapplicable regulatory requirements continue tobemet.Basedon theconsiderations discussed above, (1) there is reasonable assurance that thehealth andsafety ofthepublic willnot beendangeredby operation intheproposed manner, (2)such a ctivities will beconducted incompliance with the Commission's regulations,and(3) the issuanceoftheamendment will notbeinimical tothe common defense andsecurity ortothehealth andsafety ofthe public.

5.0ENVIRONMENTAL CONSIDERATION The proposed amendment isconfined to(i) changes tosurety,insurance,and/or indemnity requirements, or(ii)changes to recordkeeping, oradministrative reporting, procedures orrequirements. Accordingly, the proposed amendment meets theeligibility criterion for categorical exclusion set forthin 10 CFR 51.22(c)(10). Therefore,pursuant to10CFR51.22(b), noenvironmental impactstatement orenvironmental assessment needbeprepared inconnection with theproposed amendment.

Theproposed change doesnotrequire anyplant modifications which affect theperformance capability ofthe s tructures,systems, andcomponents relied upon tomitigatethe consequences of postulated accidents.

Therefore, theproposed change doesnotinvolve a significant increase inthe probability orconsequences ofanaccident previously evaluated.

2.Doesthe proposed change create the possibility ofa newor different kind ofaccident from anyaccident previously evaluated?

Response: No.

Theproposed change doesnotimpact theaccident analyses. Theproposed change doesnotinvolve a physical alteration oftheplant (i.e., no newordifferent type of equipment willbeinstalled), a change inthemethod ofplant ornewoperator operation, actions. Theproposed change doesnotintroduce failure modes thatcould result in a newaccident, andthechange doesnotalter assumptions madeinthesafety analysis.
