Title:

Public Meeting with Industry to Discuss Application of Hardship Criteria for Force-on-Force Inspections in 2021 Date of Meeting: Monday May 10, 2021 Location: Teleconference Type of Meeting: Public Purpose of the Meeting: To discuss and clarify how the Nuclear Regulatory Commission staff intends to implement the Hardship Criteria for force-on-force inspections in 2021 Attendees include representatives from:

General Summary:

The office of Nuclear Security and Incident Response (NSIR) staff hosted a public meeting with representatives from NEI, NextEra, Entergy, and the UCS to discuss the application of the FOF inspection hardship criteria in calendar year (CY) 2021 during the COVID-19 Public Health Emergency (PHE). During this meeting, the NSIR staff provided additional clarification for implementation of Temporary Staff Guidance (TSG) TSG-NSIR-2021-01 Additional Guidance for Force-On-Force Inspections During the Public Health Emergency dated, February 28, 2021 Agencywide Documents Access and Management System (ADAMS) Accession No. ML21043A259.

The meeting focused on the use and intent of Criterion 5 found in Section 3.2 Basic Criteria for Hardship of the TSG. In addition, the NSIR staff presented a flowchart to better demonstrate how and when the various criteria would apply through the inspection process. NSIR staff also provided additional information and clarity as it pertained to how NRC regional offices contribute to the conduct of inspection activity. NSIR management closed the presentation by opening the floor for discussion and related questions to all participants. Questions from licensee and industry representatives were minimal and focused on clarification of when certain criterion were applicable. Based on the questions, NSIR staff determined adding the flowchart to the TSG would provide additional benefit.
