SUPPLEMENTAL INFORMATION NEEDED FOR ACCEPTANCE OF REQUESTED LICENSING ACTION RE: TEMPORARY EXEMPTION FROM ANNUAL FORCE-ON-FORCE EXERCISE REQUIREMENT OF 10 CFR PART 73, APPENDIX B, GENERAL CRITERIA FOR SECURITY PERSONNEL, SUBSECTION A.7 (EPID L-2021-LLE-0024 [COVID-19])

Dear Mr. Peters:

By letter dated April 16, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21106A293), Vistra Operations Company LLC (the licensee) submitted a temporary exemption request from Title 10 of the Code of Federal Regulations (10 CFR) Part 73, Physical Protection of Plants and Materials, Appendix B, General Criteria for Security Personnel,Section VI, Nuclear Power Reactor Training and Qualification Plan for Personnel Performing Security Program Duties, subsection A.7, regarding the timeframe for conducting the annual force-on-force (FOF) exercises scheduled for the first quarter of calendar year (CY) 2021 at Comanche Peak Nuclear Power Plant, Unit Nos. 1 and 2 (Comanche Peak), as required by 10 CFR Part 73, Appendix B, Section VI, subsection C.3(I)(1). The proposed exemption request would allow the deferment of the completion of the CY 2021 annual FOF exercises from June 15 to September 30, 2021. By letter dated December 22, 2020 (ADAMS Accession No. ML20350B666), the NRC granted the licensees request to exempt Comanche Peak for CY 2020 from the annual FOF exercise requalification requirement of security personnel in subsection C.3.(l)(1) of 10 CFR Part 73, Appendix B, Section VI. Thus, the last time the licensee performed the required annual FOF exercises for Comanche Peak was in May 2019.

The Enclosure to this letter contains Security-Related Information. When separated from the Enclosure, this letter is decontrolled.

OFFICIAL USE ONLYSECURITY-RELATED INFORMATION OFFICIAL USE ONLYSECURITY-RELATED INFORMATION The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this exemption request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

In accordance with 10 CFR 73.5, Specific exemptions, the Commission may grant, upon application of any interested person or on its own initiative, such exemptions from the requirements of the regulations in 10 CFR Part 73 as it determines are authorized by law and will not endanger life or property or the common defense and security, and are otherwise in the public interest.

The NRC staff has reviewed your application and concluded that the additional information delineated in the enclosure to this letter is necessary to enable the staff to make an independent assessment regarding the acceptability of the proposed exemption in terms of adequate protection of public health and safety and the environment.

In order to make the application complete, the NRC staff requests that Vistra Operations Company LLC supplement the application to address the information requested in the enclosure by May 12, 2021. This will enable the NRC staff to begin its detailed technical review. If the application is subsequently accepted for review, you will be advised of any further information needed to support the NRC staffs detailed technical review by separate correspondence.

The information requested and associated timeframe in this letter were discussed with Jack Hicks of your staff on May 4 and 6, 2021.

The NRC staff has determined that the enclosure contains security-related information (SRI) pursuant to 10 CFR 2.390, Public inspections, exemptions, requests for withholding, and thus, is not available to the public.
