FINAL CLOSURE OF ACTIONS TO ADDRESS THE OFFICE OF THE INSPECTOR GENERALS AUDIT RECOMMENDATIONS ON THE U.S. NUCLEAR REGULATORY COMMISSIONS OVERSIGHT OF SPENT FUEL POOLS (OIG-15-A-06)
The U.S. Nuclear Regulatory Commission (NRC) staff received the Office of the Inspector General (OIG) report OIG-15-A-06, Audit of NRCs Oversight of Spent Fuel Pools, dated February 10, 2015. In a memorandum dated March 18, 2015 (Agencywide Documents Access and Management System Accession No. ML15056A651), the staff described specific actions that the NRC will take to address the four recommendations in OIG-15-A-06. The staff previously closed Recommendations 2, 3, and 4. The attached Enclosure updates the status of Recommendation 1. The staff has completed the final action necessary to close Recommendation 1. Therefore, the staff requests Recommendation 1 be closed.

Recommendation 1 Provide a generic regulatory solution for spent fuel pool criticality analysis by developing and issuing detailed licensee guidance along with NRC internal procedures.
Planned Action:
Upon a satisfactory conclusion to the U.S. Nuclear Regulatory Commissions (NRC) review of Nuclear Energy Institute report (NEI) 12-16, incorporate this detailed guidance into NRC internal processes through a regulatory guide (RG).
April 2021 Status Update:
Regulatory Guide 1.240, Fresh and Spent Fuel Pool Criticality Analyses, which endorses NEI 12-16, Revision 4, Guidance for Performing Criticality Analyses of Fuel Storage at Light-Water Reactor Power Plants, dated September 26, 2019, (Agencywide Documents Access and Management System Accession No. ML19269E056) with appropriate limitations and conditions, was published in the Federal Register on March 10, 2021. Publishing RG 1.240 was the final action needed to complete OIG-15-A-06 Recommendation 1.
Therefore, the staff requests Recommendation 1 be closed.
To optimize resources and avoid duplicate work, the SRP update planned for this activity was moved to NRRs SRP Modernization Effort. Reference the February 10, 2021, update, (ADAMS ML21041A578).
