ZION NUCLEAR POWER STATION, UNITS 1 AND 2 - ORDER EXTENDING THE EFFECTIVENESS OF THE APPROVAL OF THE TRANSFER OF THE LICENSES FROM ZIONSOLUTIONS, LLC TO EXELON GENERATION COMPANY, LLC AND CONFORMING ADMINISTRATIVE LICENSE AMENDMENTS (CAC NO. 000079; EPID L-2020-LLO-0007)

Dear Mr. Sauger:

By letter dated July 24, 2018 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML18211A303), as supplemented by letters dated January 21, 2019, and February 8, 2019 (ADAMS Accession Nos. ML19028A175 and ML19043A673, respectively), ZionSolutions, LLC (ZS) and Exelon Generation Company, LLC (Exelon)

(collectively, the applicants) submitted an application, pursuant to Section 184 of the Atomic Energy Act of 1954, as amended, and Sections 50.80, Transfer of licenses, and 72.50, Transfer of license, of Title 10 of the Code of Federal Regulations (10 CFR), requesting that the U.S. Nuclear Regulatory Commission (NRC) consent to the direct transfer of Facility Operating License Nos. DPR-39 and DPR-48 for the Zion Nuclear Power Station, Units 1 and 2, respectively (Zion), and the associated general license for the Zion independent spent fuel storage installation. Specifically, the applicants requested that the NRC consent to the direct transfer of ZSs ownership interest in, and management authority of, Zion to Exelon. The applicants also requested NRC approval of conforming amendments to the licenses pursuant to 10 CFR 50.80 and 10 CFR 50.90, Application for amendment of license, construction permit, or early site permit.

On November 26, 2019, the NRC issued an Order (transfer Order) approving the transfer and approving draft conforming administrative license amendments (ADAMS Accession No. ML19228A130). The transfer Order was intended to be implemented upon the completion of decommissioning activities at the Zion site and was effective for one year from its date of issuance. By letter dated August 27, 2020, ZS submitted a written application to extend the effectiveness of the transfer Order by six months, until May 26, 2021. That request was approved by Order dated October 21, 2020.

By letter dated April 15, 2021 (ADAMS Accession No. ML21112A164), ZS requested an extension of the effectiveness of the transfer Order for an additional six months to allow sufficient time to complete decommissioning activities.

Sauger The NRC staff has considered the information presented in the April 15, 2021, extension request and determined that ZS has shown good cause for extending the effectiveness of the transfer Order by an additional six months from May 26, 2021, to November 26, 2021. The enclosed Order approves this extension. The previously approved conforming administrative license amendments will be issued and made effective when the transfer transaction is consummated.

The NRC Safety Evaluation enclosed with the transfer Order remains valid. The second extension Order is being forwarded to the Office of the Federal Register for publication.
