INVESTIGATION

SUMMARY

, OFFICE OF INVESTIGATIONS CASE NUMBER 2-2021-003F

Dear Mr. Bittner:

On March 2, 2021, the Nuclear Regulatory Commission (NRC) sent you a letter (ML21061A076) about our Office of Investigations (OI) determination regarding a fire in the supercompactor that occurred in June 2020. Because that letter may not have accurately reflected the possibility of future agency actions, we are issuing this letter to clarify that summary further.

The NRC Office of Investigations determined there was no specific indication of wrongdoing associated with NRC regulations. Barring receipt of additional relevant information, we plan no further investigation of this matter; however, additional inspection and enforcement are being considered for the event, as warranted. Should you have any questions concerning this letter, please contact us. The subject OI case remains closed.

Copies of documents related to this report may be requested under the Freedom of Information Act (FOIA). Requests for records under FOIA can be made to U.S. Nuclear Regulatory Commission, Mail Stop T-5 F09, Washington, DC 20555-0001, or you can fax your request to the NRC Rockville, Maryland office at (301) 415-5130, or email at FOIA.resource@NRC.GOV. Any information provided under FOIA will be purged of names and other potential identifiers to the extent consistent with that act.

Per 10 CFR 2.390 of the NRC's "Rules of Practice and Procedure," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).

ADAMS is accessible from the NRC Web site at http://www.nrc.gov/NRC/ADAMS/index.html (the Public Electronic Reading Room).
