Enclosed is export application XMAT456, dated March 15, 2021, from Linde Gas North America, LLC. The application requests the export of 4,275 kilograms of deuterium compounds to Intel Ireland Ltd., for manufacturing of semiconductor devices.
In accordance with our mutual understandings documented in August 2016, Processing applications for licenses for exports of deuterium, we would appreciate receiving your judgement as to whether:
The facts of the proposed export are consistent with non-nuclear end use;
The Executive Branch does not see a need for assurances from the recipient government; and
The proposed export would not be inimical to the common defense and security of the United States.
Please note that the licensee has requested that the intermediate and ultimate foreign consignees names be excluded from public view. The NRC will not include this information in the public record and requests that the Executive Branch agencies protect it as well.
