Lauren, Based on our call with the Point Beach folks today, I would like to add brief statement to the SLRA Acceptance Letter (in addition to what we sent you before Christmas). We would like to add the following:

NextEra has not provided a coastal zone management act (CZMA) consistency certification determination from the State of Wisconsin that license renewal will be compliant with the enforceable provisions of the state coastal zone program. The staff cannot issue the renewed license without this CZMA certification. As such, the lack of the CZMA certification has the potential to adversely impact the issuance of the renewed license.

So, were basically adding a similar statement to what we provided previously for the 401 CWA permit.

Please let me know if theres any issues with including this statement, or if you have any questions.

Rob, Based on the conversation we had with the Point Beach Team and our review of CZMA in the Point Beach ER, NextEra Energy does not currently have CZMA certification from the State of Wisconsin.

NextEra Energy initiated the process to obtain the Wisconsin Coastal Management Councils concurrence on their consistency certification - requesting a 45 day response. At this time, NextEra Energy has not received a response from the Coastal Management Commission.

We may want to ask Lauren to add the following to the Point Beach acceptance letter.

Point Beach SLR Acceptance Review

Lauren, By letter dated November 16, 2020 (Agencywide Documents Access and Management System (ADAMS)

Accession Package Number ML20329A292), NextEra Energy Point Beach, LLC (NEPB), (the applicant),

submitted an application for Subsequent Renewed Operating Licenses for Point Beach Power Nuclear Plant Units 1 and 2.

The purpose of this email is to provide the results of NMSS/REFS/ELRBs acceptance review. The acceptance review was performed to determine if there is enough technical information in scope and depth to allow my staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

NMSS/REFS/ELRBs staff reviewed their environmental assignments and concluded that technical information is provided in enough detail to enable the branch to complete its detailed technical review and make an assessment regarding the acceptability of the proposed request. However, this determination does not preclude requests for additional information and an audit to look at supporting information. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the staffs ability to complete the detailed technical review are identified despite the completion of the acceptance review.

NMSS/REFS/ELRB estimates for the SLRA review are in RRPS and are based on NMSS/REFS/ELRBs initial review of the application and they could change due to several factors, including requests for additional information and unanticipated addition of scope to the review. If there are emergent complexities or challenges in the review that would cause changes to the initial forecasted completion dates or hours, the reasons for the changes, along with the new estimates, will be communicated to you.

While the staff found the application acceptable for review, we recommend the following statement be added to the paragraph in the acceptance letter relating to schedule uncertainties:

NextEra has not provided a Clean Water Act (CWA) Section 401 Water Quality Certification (WQC) from the Wisconsin Department of Natural Resources (the CWA 401 Certifying Authority), or a documented waiver or other documentation from the Certifying Authority that Section 401 Certification does not apply to renewal of the operating licenses for Point Beach. The staff cannot issue the renewed license without this certification or documented waiver from the Certifying Authority. As such, the lack of Section 401 certification has the potential to adversely impact the issuance of the renewed license.
