This letter is being sent in response to an inquiry from Aaron Thomlinson, NRC Quality Assurance Engineer, regarding The Johns Hopkins Applied Physics Laboratory, LLC's (JHU/APL) November 23, 2016 request for a Part 71 approval of JHU/APL's Fissile Quality Assurance Program (QAP), reference accession numberML16337A073 (docket number 71-0960).
JHU/APL is a Maryland agreement state licensee (number MD-27-014-02). At the time of the ML163_37A073 request, JHU/APL was only allowed the possession and use of Special Nuclear Material (SNM) un'der MD-27~01 *4-02. The request was submitted to the NRC for the approval of JHU/APL's QAP because of an error in the Code of Maryland Regulations (COMAR) which directed its licensees to seek NRC approval as opposed to the State of Maryland's approval. JHU/APL was made aware of the error in the c9MAR by Jon Woodfield, NRC Storage and Transportation Engineer, in February 2017. JHU/APL followed Mr. Woodfield's guidance to submit the request to the State of Maryland. The Maryland Department of the Environment (MDE) approved )HV/APL's QAP in August of 2017. JHU/APL was not

I aware that the initial ML16337A07,3 request remained open with the NRC. It was assumed to have been j
closed based on the last correspondence with Mr. Woodfield.
JHU/APL has since acquired an NRC Part 70 SNM license (number SNM-7004, issued February 22, 2019) for the possession and use of additional quantities of SNM. However, JHU/ APL does not require an NRC approved QAP for the receipt and shipment of SNM under SNM-7004 because those activities will be conducted in accordance 'f4'ith the Maryland approved QAP.,:herefor~ please accept this le!ter a~ a formal withdrawal of JHU/APL's QAP ~pproval request made in ML1~337A073.
