CLINTON POWER STATION - NOTICE OF VIOLATION; NRC INVESTIGATION REPORT NO. 3-2020-004; NRC SECURITY INSPECTION REPORT NO. 05000461/2020405 Dear Mr. Rhoades This letter refers to U.S. Nuclear Regulatory Commissions (NRC) November 2, 2020, letter that conveyed the agencys determination of a greater-than-green security finding. In the letter we also informed you that we had not completed the enforcement analysis associated with the finding. Our November 2, 2020, letter can be found in the NRCs Agencywide Documents Access and Management System (ADAMS) at Accession No. ML20307A569. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.

On January 28, 2020, NRCs Office of Investigations, Region III Field Office initiated an investigation into security-related deliberate concerns associated with the greater than green finding. This investigation was completed on October 16, 2020. Based on the evidence developed during the investigation the concerns were not substantiated.

After considering the information developed during the inspection and investigation, the NRC has concluded a security-related violation of NRC requirements occurred and is associated with the Greater than Green finding issued in our November 2, 2020, letter. The violation is cited in the enclosed Notice of Violation (Notice) (Non-Public)(Enclosure 1). The specific details concerning the significance of the finding and violation are described in Inspection Report No. 05000461/2020403 (Non-Public) and in the Determination of Significance and Description of Corrective Actions (Enclosure 2) (Non-Public). In accordance with the NRC Enforcement Policy, the violation is considered an escalated enforcement action because it is associated with a Greater than Green finding.

The NRC has concluded that the information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence, and the Enclosures 1 and 2 contain Sensitive Unclassified Non-Safeguards Information.

When separated from the enclosures, this transmittal document is decontrolled.

In accordance with Title 10 of the Code of Federal Regulations (CFR) 2.390 of the NRC's Rules of Practice, a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or in the ADAMS, accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosures will not be made available electronically for public inspection in the NRC Public Document Room or from the NRC's document system (ADAMS). If you choose to respond and Security-Related Information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1).
