Dear Mr. Smith:

We have reviewed the final revisions to the regulations Mississippi State Department of Health regulations Title 15, Part 21, Subpart 78 Radiological Health, received by our office on January 21, 2021. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules in 10 CFR Parts 19, 20, 30, 31, 32, 33, 34, 35, 36, 39, 40, 70, 71, and 150; and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1, 2018-2, 2018-3, 2019-1, and 2019-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with you on February 5, 2021.

As a result of our review, we have two comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Mississippi, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Mississippi regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Access authorization program requirements Mississippi adopts §37.23 by reference. However, Mississippi needs to have the oath or affirmation certificates sent to their State Agency not the NRC.

Mississippi needs to replace the reference to ATTN: Document Control Desk; Director, Office of Nuclear Material Safety and Safeguards in Rule 1.16.1 with their State Agency contact information.

MS need to make these changes in order to meet the Compatibility Category B designation assigned to 10 CFR 37.23(b)(2).

2 Rule 1.13.1

§71.101(c) 2019-2 C

Quality Assurance requirements Mississippi adopts §71.101 by reference. However, Mississippi has their licensees quality assurance plan being sent to the NRC in §71.101(c).

Mississippi needs to have their licensees quality assurance plan sent to their State Agency in Rule 1.13.1.,

and not the NRC.

Mississippi needs to make these changes in order to meet the Compatibility Category C designation assigned to 10 CFR 71.101.
