As a result of a release of documents under FOIA/PA-2016-0725, please change the availability to public, sensitivity to non-sensitive, the release date to immediate release, and add SUNSI Review Complete and FOIA to the keyword field of the following records: ML100271591. Not e this record was previously released with redactions during the processing of FOIA/PA-2012-0128 as ML12363A085. It has been determined that the concurrence page previously redacted as "outside scope" should be restored, and that the exact text of item 3, which had been redacted under 7F, had been released in ML103430047. Please strike-out the restrictive header /footer. ML102910480. Note this record was previously released as ML102990064, as part of FOIA/PA-2013-0213 (web package is ML14154A304). Perhaps it was given a new ML# just to accommodate the strike-out of the restrictive header/footer. Maybe that was t he practice a few years back, but since this requester has asked for t he document by its original ML#, and consistent with our current practice, we wanted to change its profile/availability as well. FOIA_2016-0725 Importance: High Jeremy, I wanted to drop a quick note of thanks for this one. I now have it back from the OGC mailroom with your NLO. I note that during the time when it was sent over to OGC for concurrence review, and now, the revision to Form 464 (which reflects the 90 days in which to appeal adverse determinations) has been completed. So, when I thought the package was lost, I recreated the response on the newly revised Form 464 (which eliminates all the verbiage we had to use while the rule was finalized to implement the 90 day period); can I ask you for a quick email confirming your NLO, which I can include in the file? That way I can use the revised Form 464 response (which won't have your handwritten concurrence in the grid). Thanks.

The two records were given to Criscione in their entirety previously by us. So, it should be simple. I've attached the draft of the Form 464 and copies of the two records (you'll see that ML16238A014 has the F464 that released the ADM memo in arguably reverse order).. I toyed around with the idea of including in the Comments Section something about the records being made public. For now, I didn't check either the public or non-public ADAMS boxes. Under the regs, they pertain to him, so arguably not made public (and they weren't made public in the prior requests, 2014-0236 and 2014-0269 (because both came out of OIG investigation files but referred to ADM/FOIA for response). But we have his waiver, allowing the records to be made publicly available. And, we know we have 3 or more requests for it (assuming we don't aggregate) anyway. But I figured that since we don't know what we're doing, it makes better sense to be silent. Of course, if you think otherwise, let me know and I can make changes accordingly.

The NRC's Freedom of Information Act (FOIA) Office has received several requests (their reference numbers are identified in the Subject line of this email) that seek copies of, inter alia, a video clip taken by an NRC resident inspector (on his cell phone camera) of flooding that occurred at the St. Lucie nuclear power plant on January 9 [no year given]. In searching the Licensee Event Report database NRG makes available to the public, I came across a LER that appears to coincide with the events shows in the video clip. It is also attached. Our office has made a preliminary determination that there is no basis on which to withhold the video clip from these requesters. We wanted to let you know. Should you have any questions, or concerns, please contact the undersigned at your earliest opportunity. The NRC's Freedom of Information Act (FOIA) Office has received several requests (their reference numbers are identified in the Subject line of this email) that seek copies of, inter alia, a video clip taken by an NRC resident inspector (on his cell phone camera) of flooding that occurred at the St. Lucie nuclear power plant on January 9 [no year given]. In searching the Licensee Event Report database NRG makes available to the public, I came across a LER that appears to coincide with the events shows in the video clip. It is also attached.
