UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 December 10, 2020 The Honorable John A. Barrasso Chairman, Committee on Environment and Public Works United States Senate Washington, DC 20510

Dear Mr. Chairman:

The U.S. Nuclear Regulatory Commission (NRC) is publishing the following document in the Federal Register:

Title:

Petition for rulemaking; Denial: Fitness-for-Duty Program [NRC-2009-0482; PRM-26-3; NRC-2010-0304; PRM-26-5].

  • Description of the document: The NRC is denying two petitions for rulemaking related to the fitness-for-duty program because the larger rulemaking that the PRMs had been incorporated into has been discontinued. Per NRC regulations, when the larger rulemaking is discontinued PRMs are documented as denied (without prejudice).

For more information, see the enclosed document.

Please contact me at 301-415-1776 if you have questions or need more information.

Sincerely, Eugene Dacus, Director Office of Congressional Affairs
