Dear Assemblywoman Galef:

On behalf of the U.S. Nuclear Regulatory Commission (NRC, the Commission), I am responding to your letter dated November 4, 2020, addressed to Chairman Svinicki, requesting that the NRC hold a public meeting before a decision is made on the transfer of the Indian Point Energy Center to Holtec International and Holtec Decommissioning International, LLC. I am responding to your letter because there are pending requests for a hearing on the Indian Point license transfer application, and given the nature of the Commissions adjudicatory role, the Commission must remain impartial and cannot comment at this time.

Public engagement is part of the fabric of how the NRC conducts business, and I want to assure you that the agency recognizes the publics interest in the regulation of nuclear activities. The NRC is committed to encouraging public involvement, and fully considers input from members of the public in its decision-making.

In this spirit, the NRC issued a Federal Register Notice on January 23, 2020, to provide an opportunity for members of the public to comment on the Indian Point license transfer application. The comment period was originally 30 days and was extended on February 19, 2020, for a total period of 60 days. In addition, the NRC staff discussed the license transfer application and the expected schedule during the Indian Point annual assessment public meeting held on September 22, 2020. As a result of these outreach efforts, the NRC received more than 400 comments from various stakeholders on a broad range of topics, including many financial concerns. The NRCs detailed safety evaluation report on the license transfer application, including analysis of all pertinent financial considerations, can be found in the agencys official recordkeeping system, the Agencywide Documents Access and Management System, at Accession No. ML20297A333.

NRC regulations for license transfer applications at Title 10 of the Code of Federal Regulations 2.1316 require that the NRC promptly issue its licensing decision after the completion of its safety evaluation report. Therefore, the NRC issued an order approving the Indian Point license transfer application on November 23, 2020. However, because hearing

requests are pending on the license transfer application, the issued order is subject to the Commissions authority to rescind, modify, or condition the approved transfer based on the outcome of any hearing that may be granted.
