NRC Enforcement Policy AGENCY: Nuclear Regulatory Commission.

ACTION: Proposed policy statement revision; request for comment.

SUMMARY

The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a proposed policy statement titled NRC Enforcement Policy (the Policy). The NRC is soliciting comments from interested parties, including public interest groups, States, members of the public, and the regulated industry (i.e., reactor, fuel cycle, and material licensees, vendors, and contractors) to assist the NRC in revising its policy.

DATES: Submit comments by [INSERT DATE 60 DAYS AFTER PUBLICATION IN THE FEDERAL REGISTER]. Comments received after this date will be considered if it is practical to do so, but the NRC is able to ensure consideration only for comments received before this date.

I. Obtaining Information and Submitting Comments A. Obtaining Information Please refer to Docket ID NRC-2020-0261 when contacting the NRC about the availability of information for this action. You may obtain publicly-available information related to this action by the following methods:

The NRC cautions you not to include identifying or contact information that you do not want to be publicly disclosed in your comment submission. The NRC does not routinely edit comment submissions to remove identifying or contact information.

II. Background The mission of the NRC is to license and regulate the Nations civilian use of byproduct, source, and special nuclear material to ensure adequate protection of public health and safety, promote the common defense and security, and protect the environment. Adequate protection is presumptively assured by compliance with the NRCs regulations. The NRC Enforcement Policy (the Policy) contains the basic process used to assess and disposition apparent violations of NRC requirements.

III. Discussion This notice provides the public with an opportunity to review and provide comments on the draft revision to the policy found in ADAMS under Accession No. ML20297A235. Each proposed revision is referenced with a bracketed number, called an item number. Each item number is listed in the Enforcement Policy Revision Summary document (ADAMS Accession No. ML20297A243) and includes a brief description of the proposed revision. Comments received during this 60-day comment period will be considered for the final version of the policy.
