REQUEST FOR EXEMPTION FROM 10 CFR 50.82(a)(8)(i)(A) AND 10 CFR 50.75(h)(1)(iv) FOR HOLTEC DECOMMISSIONING INTERNATIONAL, LLC (EPID L-2020-LLE-0010)
Dear Ms. Sterdis:
The U.S. Nuclear Regulatory Commission (NRC) has approved the enclosed exemption from specific requirements of Title 10 of the Code of Federal Regulations (10 CFR) 50.82(a)(8)(i)(A) and 10 CFR 50.75(h)(1)(iv) for Holtec Decommissioning International, LLC (HDI). This action is in response to your application dated February 12, 2020 (Agencywide Documents Access and Management System Accession No. ML20043C539), which requested the exemption to permit HDI to make withdrawals from the Indian Point Nuclear Generating Station, Unit Nos. 1, 2, and 3 (referred to individually as IP1, IP2, and IP3, respectively, and collectively as the Indian Point Energy Center (IPEC)) nuclear decommissioning trust funds for spent fuel management and site restoration activities for IP1, IP2, and IP3, respectively, and to make these withdrawals without prior notification to the NRC, similar to withdrawals for decommissioning activities made in accordance with 10 CFR 50.82(a)(8).
This exemption was requested in relation to the November 21, 2019, request by Entergy Nuclear Operations, Inc., on behalf of itself, Entergy Nuclear Indian Point 2, LLC, Entergy Nuclear Indian Point 3, LLC, Holtec International (Holtec), and HDI, for NRC consent to the transfer of Provisional Operating License No. DPR-5 for IP1, Renewed Facility Operating License Nos. DPR-26 and DPR-64 for IP2 and IP3, respectively, and the general license for the IPEC independent spent fuel storage installation to Holtec subsidiaries Holtec Indian Point 2, LLC and Holtec Indian Point 3, LLC, with the operating authority under the licenses to be held by Holtec subsidiary HDI.
A copy of the exemption is enclosed. The exemption has been forwarded to the Office of the Federal Register for publication.
