Dear Mr. DeLaBarre:

Enclosed is an application dated April 7, 2020, received by the U.S. Nuclear Regulatory Commission from EnergySolutions, requesting Amendment No. 04 to license XW010 for the export of radioactive waste from/to Canada. Please note, this license will be valid for an additional six years.

The purpose of the amendment is to: (1) renew the cumulative radioactivity limits for XW010 of the total quantities of radioactive material/waste and increasing the weight of radioactive material/waste exported to Canada; (2) adding to the export Permit the authorization to export primary heat transfer pumps back to Canada if they are deemed unrepairable and categorized as waste for disposal in Canada if not processed for metal melt recycle; and (3) extending the validity of the license from December 31, 2020 until December 31, 2026.

Before taking action on this NRC license application, we would appreciate your assistance in notifying the Canadian Government of the proposed radioactive waste export and obtaining any comments that the Canadian Government might have in the context of the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management.

We also request your views as to whether the subject export will be Consistent with the Convention's guidelines.
