SUMMARY

OF SEPTEMBER 14, 2020, PUBLIC TELECONFERENCE WITH TENNESSEE VALLEY AUTHORITY TO DISCUSS A PLANNED LICENSE AMENDMENT REQUEST (EPID L-2020-LRM-0079)

On September 14, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff held a Category 1 public teleconference with representatives of the Tennessee Valley Authority (the licensee) to discuss a planned license amendment request (LAR) regarding the use of ATRIUM 11 fuel at Browns Ferry Nuclear Plant, Units 1, 2, and 3 (Browns Ferry). This meeting was a follow-on to a related June 8, 2020, meeting. The summary for that meeting can be found at Agencywide Documents Access and Management System Accession (ADAMS)

No. ML20162A153. The meeting notice and agenda for this meeting, dated August 21, 2020, are available at ADAMS Accession No. ML20234A612. A list of attendees is enclosed. No regulatory decisions were made at this meeting.

The licensee had requested the meeting to update the NRC staff on the options it is considering to incorporate the yet-to-be-approved topical report addressing the Best-estimate Enhanced Option III (BEO-III) method, which the licensee intends to use to determine Minimum Critical Power Ratio versus time. The licensee reminded the NRC staff that the options that it had previously discussed were (1) incorporation of a generically approved topical report, assuming the approval of the topical report occurs in a timeframe that supports it, and (2) if the approval schedule does not support that approach, the licensee would submit its LAR referencing the draft topical report and would provide site-specific justification for its use at Browns Ferry. The licensee described a third approach it is considering due to evolving circumstances. Should the NRC staff need to engage the Advisory Committee on Reactor Safeguards on the staffs draft topical report safety evaluation, which would delay approval of the topical report to a date later than needed for the licensees planned LAR submittal date, the licensee stated that an additional approach would be to request an exception from the NRC staff that would allow the licensee to reference the NRC staffs draft safety evaluation in its LAR. The licensee stated that it would request approval of the exception prior to submitting the LAR. Should the NRC staff agree, the LAR would reference the draft safety evaluation, then once the topical report is approved, the licensee would update its LAR to reference the approved topical report. The licensee stated that this is the same approach taken by another licensee for a different topical that it was incorporating in its LAR for the use of ATRIUM 11 at its facility.

The NRC staff stated that it was aware of the precedent that the licensee described and that, should circumstances be such that the licensee elects to take that approach, the staff would need sufficient time to review the exception request and make a determination. The NRC staff and licensee agreed that in that event, the licensee should request another public meeting to further discuss its proposed approach with the staff. Based on its planned submittal date of June 2021, the licensee stated that the meeting would likely need to occur in February 2021.
