SUBJECT:

STAFF REQUIREMENTS - SECY-98-074 - PROCESS FOR THE DECLASSIFICATION AND RELEASE OF INVENTORY DIFFERENCE DATA The Commission has not approved the staffs proposal to authorize the Director of the Division of Fuel Cycle Safety and Safeguards to automatically declassify the inventory difference data.

The Commission may at times be privy to information regarding this data which the staff may not have at its disposal and the proposed process would leave both the EDO and the Commission out of the determination process.

However, the Commission has agreed to delegate its authority to the EDO to automatically declassify the ID data reported to the NRC after 6 months from the date of the ID determination and in the absence of active inv: stigation, thereby eliminating the annual Commission negative consent paper for the declassification of data. The staff is encouraged to develop an innovative approach for transmitting the ID data to and from the EDO that is less burdensome than the current practice of preparing each annual NUREG report first as a classified document. In implementing this new approach, the staff should ensure that the Commission is informed of any active investigation associated with the data, and all declassified data continues to be made publicly available.
