Gordon E. Edison, Senior Project Manager Project Directorate 11-1 Division of Reactor Projects - 1/11 Office of Nuclear Reactor Regulation
SUBJECT:
FEE WAIVER REQUEST Enclosed is a letter dated February 9,1998, from Virginia Electric and Power Company (VEPCO) and the Westinghouse Owners Group (WOG). The letter requests a waiver of fees for staff review of certain submittals by VEPCO and WOG related to a pilot program effort for a risk-informed inservice inspection program. A public meeting with VEPCO, WOG and the Nuclear Energy Institute (NEI) is scheduled for March 25,1998, at 10:00 AM in room O-12B11 at VEPCO's request to more fully explore whether there is a basis for fee waiver.
Please provide any guidance you think appropriate for NRC to come to a decision in this matter.

Westinghouse Owners Groun Review of Westinghouse Owners Groun Toolen1 Recort and Surry Unit 1 Risk informed Inservice Insnection Submittals Dear Dr. Sheron;
'The Westinghouse Owners Group recently submitted a revised topical report in Reference I and Virginia Electric and Power Company, in cooperation with the WOG, provided a corresponding 6P ot plant submittal il for Surry Unit 1 in Reference 2 to be reviewed by the NRC as an acceptable approach'for establishing riskq )
informed inservice inspection (RI-ISI) progmms. 'Ihis letter requests the NRC Staff to further consider the D generic, first of e-kind efforts involved in this combined subminal in establishing any fees associated with the review of these docuire.nts.
As outlined in Reference 3, the NRC has already waived any foes associated with the review of the WOG Topical report. The NRC agrood that the waiver request for this document mocts criterion thase of Footnote 4 to 10 CFR 170.21. This footnote states that foes will not be asseseed for requests / reports submitted to the NRC as a means of exchanging information between industry organizations and the NRC for the purpose of supporting gencric regulatory improvements or efforts.

'Ihe Surry Unit 1, or Surry, submittal is tightly integrated with the WOG Topical Report. While the Surry submittal provides plant speci6c information on RI 2SI, it also includes generic, Hrst of a-kind approaches.
that will support your planned generic regulatory improvement activities. For example, the NRC recently issued a request for additional information (RAI) in Reference 4 based on a prehminary review of the Suny RI ISI pilot program submittal. The staff determined that more information is needed in Sve areas. While the Arst area deals with the results of the probabilistic risk assessment (PRA) and pipe failurs calculations, responses to the remaming four areas require either generic or Srst of a land efforts related to -
implementation, meeLing, and conective actaan programs, e
how the requiromants of NRC draft Standard Review Plan Chapter ).9.s, Subsection 1.2.1 are e
addressed dealing with defense-in<lepth, W* safety margins, and anociated enginsonag analyses, and required sensitivity studies to address the impact ofhighly uncertain PRA modeling assumptions a
and techniques.
The WOG is assisting in the development of appropriate responses to these RAls because this information will
-(\\'
set a procedent for owners who decide to embark on RI-ISI programs for their nuclear units following Surry.
Given this interrelationship of the Surry pilot plant submittal to the WOG Topical Report and the Srst-of4-(' kind efforts required to support your planned generic regulatory improvement activities, a waiver of fees to review this submittal is also requested. In particular, we believe that this waiver request for the Surry submittal also meets criterion throc of Footnote 4 to 10 CFR 170.21. Additionally, we believe the Surry submittal meets criterion two of Footnote 4 to 10 CPR 170.21 where information is being provided to assist the NRC in developing a regulatory guide. The information, approaches, and results from Surry will amist the NRC in finalizing draft DG 1063 and its companion Standard Review Plan Chapter 3.9.8.
We appreciate your consideration of this request, and we would be pleased to further discuss this matter with you by telecon or by meeting, as required.
Please direct any questions or comments to either of us. Mr. Liberatori can be reached at 914-734-5676 and Mr. Saunders can be contacted at 804-273 2101.
Very truly yours, Louis F. Liberatori, Jr., Chairman Robert F. Sataders,Vice President Westinghouse Owners Group Nuclear Engineering r.nd Senices Virguus Electric and Power Company I
