SUPPLEMENTAL INFORMATION (NRC INSPECTION REPORT 99990004/97-04, INVESTIGATION REPORT 4-97-038, AND DEMAND FOR INFORMATION)

Dear Mr. Judd:

This refers to our letter and Demand For Information (Demand) sent to you on April 21,1998. In that letter we identified one apparent violation and that the violation is being considered for escalated enforcement action. The apparent violation involves your possession of special nuclear material in quantities that exceeded the limits specified in 10 CFR 150.10 and 150.11 between May and September 1997. Further, our letter informed you that we are concerned that this apparent violation involves a careless disregard for the NRC's regulatory requirements with regard to " mobile" wastes. However, in recognition of the ongoing enforcement between the State of Utah and Envirocare involving the same issue, we postponed our enforcement decision until the conclusion of the State's enforcement process, in order to have assurance that Envirocare will comply with NRC requirements given the potential willfulness involved, the NRC required certain information be provided in the Demand. Envirocare provided its response to the Demand in a letter dated May 21,1998.

The NRC has not concluded its review of Envirocare's response to the Demand, and requires that Envirocare provide supplemental information in order for the NRC to make an enforcement decision. Specifically, in its May 21 letter, Envirocare listed four actions it planned to take with regard to its " Longer Term Corrective Actions." However, Envirocare provided no time frame for completing each of these actions. The NRC requests that Envirocare provide us with the estimated completion dates for these longer term corrective actions.

In addition, the NRC notes that on May 14,1998, the State of Utah's Division of Radiation Controlissued to Envirocare a Notice of Violation and Proposed imposition of Civil Penalty for 7 violations of the State's regulations. One of the violations (Violation 2) involved removing g

shipments L19743 and L19745 from the SNM (Special Nuclear Material) inventory on May 5, 1998, prior to disposal as defined in license condition 65.B.2 of Radioactive Material License UT

2300249. As a result, we request that Envirocare inform os whether this event caused i:

l Envirocare to exceed the SNM limit in 10 CFR 150. If so, we request Envirocare's perspective on the circumstances and any enhancements Envirocare may make to its corrective actions in order to ensure this violation is not repeated in the future.
