Docket No. 50-219 Facility Operating License No. DPR-16 Technical Specification Change Request (TSCR) No. 254 Primary Containment Leakage Testing In accordance with 10 CFR 50.4(b)(1), please find enclosed Technical Specification Change Request (TSCR) No. 254.

GPU Nuclear requests that Technical Specification (TS) 4.5.A.1, contained in Appendix A of the Facility License, be revised such that the first Type A test required by the Primary Containment Leakage Rate Testing Program (established to meet Option B of 10 CFR 50 Appendix J) be performed during refueling outage 18R. Currently, TS 4.5.A.1 requires that the test be performed j

during refueling outage 17R. A summary of the proposed change is included as Attachment 1. The changed page is provided as Attachment 2.

As discussed with the NRC in our meeting on August 26,1997, GPU, Inc. has announced that in addition to continued operation, it was exploring the additional options of sale or early shutdown of the OCNGS. As part ofits contingency planning, GPU assessed the benefits of all existing projects and regulatory commitments in light of this announcement. Technical Specification 4.5.A.1 has been identified as a regulatory commitment whose risk benefit would not warrant the personnel radiation exposure and cost associated with its implementation, assuming the facility would operate a single cycle after the completion of the Type A test. A copy ofGPU Nuclear's risk assessment is prosided as Attachment No. 3.

A final decision with respect to the plant's future has not yet been made. The subject TSCR requests that the requirement to perform the first Primary Containment Leakage Rate Testing Program Type A i

test be changed to 18R. The proposed change would provide GPU with the flexibility to ensure activities are conducted consistent with the future of the OCNGS.

l This license amendment application has undergone a safety review in accordance with Section 6.5 of the Oyster Creek Technical Specifications and has been evaluated under the criteria of 10 CFR 50.92.
