APPENDIX A NOTICE OF VIOLATION Combustion Engineering, Incorporated Docket No. 70-1100 Windsor, Connecticut License No. SNM-1067 As a result of an inspection conducted at the Nuclear Fuel Manufacturing Facility on August 28-29 and September 5-8, 1989, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the following violations were identified.

A '. Condition 9 of License No. SNM-1067 requires that the licensee operate in accordance with the statements, representations and conditions in Part I of the. application. Section No. 2.6.2, " Periodic Retraining," of Part I requires, in part, that production personnel who work with radioactive material and salaried personnel who enter restricted areas attend a formal annual radiation worker retraining session, with no more than 13 months between training sessions.

Contrary to the above, during July, August and September of 1989, salaried personnel were allowed to enter restricted areas and production personnel worked with radioactive material without having attended a formal radiation worker training session within the required time period.

This is a Severity Level IV Violation. (Supplement IV)

B. Condition No. 9 of License No. SNM-1067 requires that the licensee operate in accordance with the statements, representations and conditions in Part

, I of.the application. Section 2.2.2, " Administrative Responsibilities and l

Controls - Nuclear Fuel Manufacturing," of Part I requires analyses to l establish the required safety limits and controls. Section 4.1.4, " Posting Limits," of Part I requires that all work stations and storage areas be posted with a nuclear safety limit. Section 4.2.5, " Limits for Safe l Individual Units," of Part I requires that mass units of 35 kg of U0 2 in the form of powder or pellets be kept in steel containers with a maximum volume of 5 gallons. Section 4.2.6, " Interaction Criteria," of Part I requires that all mass units have a separation of at least one foot, edge i

Contrary to the above, the licensee permitted the storage of four 35 kg mass units of SNM within the Sinterability Test Hood of the Pellet Shop; however, required safety limits and controls had not been established and I posted to: (a) limit the volume of each mass unit to a 5 gallon steel container, and (b) ensure a one-foot separation between each mass unit.
