MILLSTONE NUCLEAR POWER STATION, UNIT NOS.1,2, AND 3 - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS.
MA0831, MA0832, AND MA0833)
Dear Mr. Bowling:
By letter dated March 26,1998, the Northeast Nuclear Energy Company (NNECO) submitted a Report of Investigation and requested that the report be withheld from public disclosure in accordance with 10 CFR 2.790(a)(6), Specifically, NNECO requested that the information be withheld because it contains names of individuals and other identifying information that would invade the personal privacy of the individuals if the information was publicly released.
Additionally, in an April 24,1998, letter, NNECO stated it reviewed the report to determine if it could be redacted. NNECO concluded that the document could not be redacted in such a way that the public disclosure of the document would not infringe upon the privacy of persons mentioned in the report. The Report of Investigation was submitted to the NRC as requested in the NRC's February 10,1998, letter.
We have reviewed your request in accordance with the requirements and criteria of 10 CFR 2.790, and have determined that the submitted information sought to be withheld contains privacy information. Therefore, the Report of Investigation contained in your March 26,1998, submittal will be withheld from public disclosure pursuant to 10 CFR 2.790(a)(6), and Section 103(b), of the Atomic Energy Act of 1954, as amended.
Withholding from public disclosure shall not affect the right, if any, of persons properly and directly concemed to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
