~Although there have been no' recent problems on:the. Comanche Peak docket, it'

' has' been' brought to our attention by the Document'::ontrol Desk .thatt some

< Litcensees are submitting documents which contain proprietary information without'any indication that such material is included in the submittal.

As you. know, NRC regulations provide for making licensee information available for public inspection with certain exceptions, such as personal information Nbout employees, trade. secrets, and classified data. The Document Control

Desk has frequently been receiving information that should be. withheld,- but.

.,ifor which the. transmittal. letter.does not identify it as such and'an affidavit,

' ; requesting withholding is not provided. Consequently the Document Control Desk

, personnel are' unaware that such information is a part of-the incoming document,

'and therefore, routinely. distributes copies'to the Public Document Room, appli-cable Local Public Document Room Nuclear Safety Information Center, and to NRC's microfiche contractor for filming. This results in proprietary information being made.available to the publici NRC's Document Control Desk.'cannot be responsible for ensuring that proprietary information does not get distributed and made publically available if it is not properly identified. This type of information will be withheld only if the .in-

formation is' identified in the incoming letter and an affidavit requesting that it be withheld accompanies the letter. -Request', for withholding are subject to NRC determination that withholding is appropriate in accordance with applicable regulations.-

With regard to copyrighted material, please be aware that if you submit any copy-righted materials on the docket to NRC, you must provide us authorization to reproduce such materials. Your incoming letter should identify that you are

. submitting copyrighted information and authorize its reproduction or have re- .

.ceived permission from the author (s) to allow NRC to reproduce it.
