to our telephone discussion with Mr. J. Roulo of your' staff on November 22, 1988.

These contacts were in response to your review of allegations relating to Zion Station we forwarded to you by our letter dated July. 7,1988.

,1 letter included a request that you review one allegation involving. alleged improper background screening of a. named-individual and a second which l

. involved an alleged breach of security. involving the incomplete background screening'of-two named individuals..(Allegation RIII-88-A-0060).

Your investigation results for the first allegation showed that 'a' background

' investigation that met security plan requirements was conducted by the named individual's employer and that all the relevant ~ information developed l

- during'that. background investigation was appropriately reviewed by management.

- Your.results:showed nothing in the individual's psychological test results, 3

criminal history checks or any other portion ~ of the screening process that 1

would have precluded granting access.

The allegation that the individual was not properly screened and should have been excluded from plant access was not substantiated.

Your investigation results for the second allegation substantiated the fact that two contractor employees had been granted unescorted access and later their~ access was temporarily suspended after an error was discovered in the

]

administrative screening process.

Your review shows that the contractor

. discovered that a portion Of the screening-documentation for each of the j

- two individuals wcs not available. When discovered, it appears that both the contractor and your security organization took appropriate action.

- response also shows that a short time later the documents were obtained and they showed that.the individuals met screening requirements.

Your further review showed that, although this error occurred, the individuals posed no threat to the facility.

The above referenced information, as detailed in your August 25, 1988 letter for the second allegation, is considered to be a violation of Section 4.1 of the Zion Security plan.

The twc contractor employees had been granted unescorted access prior to a review of-all the required factors.

However, I

since all the tests of 10 CFR 2, Appendix C, Section V.G.1 for licensee identified violations have been met, no Notice of Violation will be issued.

We found your investigation to be sufficient to support your conclusions and we have'no additional questions regarding this matter norcis any response I

required.. We request'that you retain the supporting documentation for your investigation of these allegations for a minimum of one year from the date of this letter.

In accordance with 10'CFR 2.790 of the Commission's regulations, a copy of this letter will be placed in the NRC Public Document Room.
