Dear Mr. Patrick:

Subject Task Order No. 2 Entitled. " Review of Reclamation Plans" Under Contract NRC-02-98-002 This confirms verbal authorization provided to Steve Boyanowski on May 4.1998 from Deborah Neff, of my staff, to commence work on May 5,1998 with a temporary ceiling of $10,000, in accordance with the task order procedures of the subject contract, this letter definitizes Task Order No. 2. This effort shall be performed in accordance with the enclosed Statement of Work and the Contractor's technical proposal dated April 28,1998, which is hereby incorporated by reference and made a part of this task order.

Task Order No. 2 shall be effective from May 4,1998 through March 30,1999 with a cost ceiling of $165,980. The amount of $151,683 represents the total estimated reimbursable I

costs, the amount of $3,680 represents the cost of facility capital, and the amount of $10,617 represents the fixed fee for this task order.

1 The obligated amount shall, at no time, exceed the task order ceiling. When and if the amount /a) paid and payable to the Contractor heceunder shall equal the obligated amount, the Contractor shall not be obligated to continue performance of the work unless and until the Contracting Officer shallincrease the amount obligated with respect to this task order. Any work undertaken by the Contractor in excess of the obligated amount specified above is done so at the Contractor's sole risk.

YES 1.0 Backaround Uranium Mill sites under license after November 8,1978, are regulated under Title 11 of the Uranium Mill Tailings Radiation Control Act (UMTRCA), which amended the Atomic Energy Act. Licensing for these sites must meet the requirements of 10 CFR 40, Appendix A.

Throughout FY 98, licensees will submit reclamation plans that will require technical review in the areas of geotechnical engineering, geochemical engineering, radon barrier design, surface and groundwater issues, erosion protection, and soil cleanup. The NRC will use the CNWRA to evaluate two rec'amation plan reviews in FY 98 and one

reclamation plan in FY99. The two reclamation plans to be reviewed in FY98 are Umetco Gas Hills Above Grade Tailings Enhanced Reclamation Design and Sweetwater Uranium 1

Project. The existing license, background information, and any information submitted j

with the request will be made available so that the reclamation plans can be reviewed in i

accordance with applicable criteria.

2.0 Objective The objective is to confirm that the proposed reclamation plan (plan) shall be in compliance with the applicable requirements of Appendix A of 10 CFR Part 40. First, the CNWRA shall perform an acceptance review to determine if enough information has been provided by the licensee to warrant a detai'ed review of the submitted plan. If not, the I

I licensee should be requested to provide what additionalinformatinn is needed to enable the initiation of an NRC review of the plan. Secondly, once accepted for review, the CNWRA shall do a detailed evaluation of the proposed plan to determine whether or not the requirements of Appendix A of 10 CFR 40 are mot. After a detailed review, if the proposed amendment is considered deficient, additional information to address the areas of deficiency shall be requested. The licensee will be requested to provide Ole information and revise the plan accordingly to meet the requirements of Part 40, Thirdly, once a plan is acceptable, the CNWRA shall provide a written Technical Evaluation Report (TER) and when necessary, an Environmental Assessment (EA). This work will be performed on Kennecott-Sweetwater Uranium Project Reclamation Plan for impoundments; Umetco Gas Hills Above-Grade Tailings Enhancement Reclamation Design; and 8)metco A-9 Pit Rectemation Plan. It is expected that by 11/15/98, the review of two reclamation plans will have progressed to issuing Request for Additional Information (RAI) stage. Completion of the remaining review and preparation of the final N -.

TER/EA should be completed by 3/30/99. Review the third reclamation plan will be identified in FY99 and the task order modified accordingly.

3.0 Technical Qualifications Reauired The CNWRA shall provide the services of a health physicist, geotechnical engineer,

1 geochemist, erosion protection / surface-water hydrologist, and/or groundwater hydrologist who have the capability to evaluate the proposed plans. Familiarity with NRC regulations and standard review procedures is required. Appropriate technical specialists will be needed, depending on the scope of the reclamation plan.

4.0 Level of Effort The total estimated level of effort for this task order is approximately 1,369 staff hours for a health physicist, geotechnical engineer, geochemist, surface water hydrologist, and groundwater hydrologist.

5.0 Comotetion Date Approximately 6 months will be required for each reclamation plan. The entire task order effort will be 11 months.

6.0 Scoce of Work The CNWRA staff shall use the Final Standard Review Plan for the Review of Remedial Action of Uranium Recovery Sites under Title il of UMTRCA (November 97), other current design guidance, examples of past amendment reviews, and discussions with NRC staff, to:

Phase 1: Acceptance Review o

Become familiar with NRC's procedures for reviewing reclamation plans.

o Evaluate the licensee's submittal, including other documentation as follows, that is necessary to perform an acceptance review of the plan:

a.

previous related licensing actions; b.

previously-approved reclamation plan; c.

relevant surface and groundwater data, soil cleanup data, radon barrier design, geotechnical data, and applicable construction details and specifications.

o Document the results of the acceptance review in a deliverable to NRC. The contractor shall not proceed with Phase 11 withcut written approval from the NRC Contracting Officer.

Phase ll: Detailed Review / Comments o

Should the NRC proceed with Phase ll, the contractor shall perform a detailed evaluation of the licensee's submittal for compliance with regulations.

o Prepare a status report which addresses CNWRA's reclamation plan review conclusions and comments, including whether or not the plan meets the standard, j

needs minor modification, er needs additional justification or supporting data.

o Repeat evaluation and comment steps as necessary to reach a decision to either deny or accept the reclamation plan. The contractor shall not proceed with Phase lit without written approval from the NRC Contracting Officer.

Phase 111: Final Review /TER/EA

o Should NRC proceed with Phase lil, the contractor shall prepare a final TER documenting the reclamation plan review (similar to an example report to be provided by NRC staff) presenting the evaluations of the request with a discussion of how it meets applicable criteria of Appendix A of 10 CFR 40. The report shall be provided as a hard copy and in diskette form compatible with the Wordperfect 6.1 processing system.

7.0 Meetina and Travel it is estimated that 1 trip for two people for three days to NRC Headquarters in Rockville, MD. and 2 trips for three people for three days to Casper Wyoming.

l The following schedule of the staff time required is based on an average estimate of time i

intervals to accomplish a typical reclamation plan review. The time required to obtain i

responses from the licensee or management apgvoval of various phases is estimated under the response column. However, amendments can cover a wide range in their complexity, so the actual time spent on each review may vary significantly. Deliverable dates are not provided because of this variability and the fact that licensee submittal dates are unknown.' But the incremental time / effort needed for each phase of the task is tabulated below to enable a delivery schedule once the task in initiated.

Technical instructions may be issued from time to time during the duration of this task. Technical instructions shall not constitute new assignments of work or changes of such nature as to justify an adjustment in cost or period of perfemsance. Directions for changes in the scope of work, cost, or period of performance will be coordinated through the NMSS Project Manager.
