SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 138 TO FACILITY OPERATING LICENSE NO. NPF-3 TOLEDO EDISON COMPANY AND THE CLEVELAND ELECTRIC ILLUMINATING COMPANY DAVIS-BESSE NUCLEAR POWER STATION, UNIl N0. 1 DOCKET NO. 50-346

1.0 INTRODUCTION

By letter dated March 8,1988 (as clarified May 24,1988), the Toledo Edison Company (TE), the licensee, requested changes to the Technical Specifications (TS's) appended to Facility Operating License No. NPF-3 for the Davis-Besse Nuclear Power Plant, Unit No.1.

The proposed changes would revise the TS's to reflect recent organizational, position and title changes.

The proposed organizational changes involve the separation of the Chemistry and Health Physics Department, without a change in function, however. The proposed organization changes also involve elevating the position of the Performance Engineering Manager to Performance Engineering Director, and changing the position titles of the two affected members of the Station Review Board to reflect these two changes, and changing the title of the Senior Vice President, Nuclear to Vice President, Nuclear.

The proposed amendment would change the title of Chemistry and Health Physics General Superintendent to Radiological Controls Superintendent in Technical Specification 6.3.1.

This proposed change would reflect the separation of the Chemistry and Health Physics Department.

The proposed changes would delete the words " Performance Engineering Manager" from Technical Specification 6.5.1.2.

This position has been elevated to Performance Engineering Director, which is included as an Engineering Director, already listed in specification 6.5.1.2.

The change in Specification 6.5.1.2 to the title of the Operations Quality Assurance Manager was superseded by a subsequent application for a license amendment in a letter dated June 20, 1988.

, Finally, the proposal requests that the title of Senior Vice President, Nuclear, contained in Technical Specification 6.5.2.2, be changed to Vice President, Nuclear, to reflect the organization changes.

2.0 DISCUSSION Consistent with the guidance provided by Regulatory Guide 1.8 (September 1975),

Specifications 6.3.1 and 6.5.1.2 of the Administrative Control requirements includes the title of Chemistry and Health Physics General Superintendent in the Chemistry and Health Physics Department. Specification 6.5.1.2 of the Administrative Controls includes the Performance Engineering Manager position, and Specification 6.5.2.2 includes the title of Senior Vice President, Nuclear.

Recent restructuring of the organization has required the licensee to submit a license amendment request for NRC approval to reflect the changes in these organizations. Additional changes requested regarding Specifications 6.2, 6.2.1, and 6.2.2 as well as Figure 6.2-1, have been superseded by Amendment 115 (August 4, 1988) to NPF-3. Also, the change in title from Senior Vice President, Nuclear, to Vice President, Nuclear, has been implemented for all specification changes requested in this application by Amendment 109 (March 9, 1988) to NPF-3, except for the requested change in Specification 6.5.2.2 which is proposed to be changed by this amendment.

3.0 EVALUATION Since Specification 6.3.1 remains consistent with the appropriate requirements for duties, responsibilities and qualifications of this position in the Standard Technical Specifications and is administrative in nature, the staff finds the proposed change acceptable. Specification 6.5.1.2 reflects organizational changes and is acceptable because it meets the acceptance criteria of Section 13.4 of NUREG-0800, Standard Review Plan and is administrative in nature. The proposed change to Specification 6.5.2.2 reflects an organizational change which is administrative in nature and remains consistent with the appropriate section of the Standard Technical Specifications. On this basis, we find this proposed change acceptable.

4.0 ENVIRONMENTAL CONSIDERATION

This amendment relates to changes in recordkeeping, reporting, or administrative procedures or requirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10).

Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

5.0 CONCLUSION

The staff has concluded, based on the considerations discussed above, that:

(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, and (2) such activities will be conducted in compliance with the Commission's regulations, and the issuance of this amendment will not be inimical to the connon defense and security or to the health and safety of the public.
