i By letter dated August 31, 1989, the NRC issued an order imposing a civil-monetary penalty,of $75,000.00 for inoperability of one train of the Containment:
Air Return and Hydrogen Skimmer System for Catawba Nuclear Station, Unit 2.
l DI'am concerned about the limited review given my response to this violation dated June 16, 1989.and that we were not given the opportunity to further discuss.our j
-reason for mitigation as we had requested.
Since further appeal'would require expenditure of additional funds and other resources with no assurance the penalty would be reduced or eliminated, I have j
decided not to appeal this decision.
Enclosed-is a check in the amount of $75,000.00.
