This will acknowledge receipt of your. letter dated August 8,1989.and your check for $75,000 in payment for the' civil per.alties proposed by NRC in a letter dated July 20, 1989.-. We note that despite paying the full arount of the civil penalty for Violation A, you deny that the electrical Junction box example constitutes a-violation. After reviewing your response the HRC staff maintains its position that a violation. occurred. While we agree that equip-t ment located below the accident flood level is of primary concern with respect to submergence, other pieces of equipment that are not in watertight enclosures and that are located above that level are also of concern.
In absence of a drain path, it would not take a large ancunt of water to.
submerge such components in many plausible circumstances. Operating experience has shown that there are a number of crecible scenarios.
In view of the
. corrective actions taken and the payment.of the civil penalty, we consider this enforcement action closed.
Your corrective actions will be examined during future inspections.
